Members of the public can obtain a copy by the contacting the Information Service at the Library of Parliament.&lt;br/&gt;&lt;br/&gt;On 8 December 2014, the Minister of Natural Resources and Minister for the Federal Economic Development Initiative for Northern Ontario introduced Bill C-46, An Act to amend the National Energy Board Act and the Canada Oil and Gas Operations Act (Pipeline Safety Act), in the House of Commons and it was given first reading. &lt;br/&gt;&lt;br/&gt;Bill C-46 amends the National Energy Board Act and the Canada Oil and Gas Operations Act in order to strengthen the safety and security of pipelines regulated by those Acts.&lt;br/&gt;More specifically, the enactment, among other things,&lt;br/&gt;(a) reinforces the “polluter pays” principle;&lt;br/&gt;(b) confirms that the liability of companies that operate pipelines is unlimited if an unintended or uncontrolled release of oil, gas or any other commodity from a pipeline that they operate is the result of their fault or negligence;&lt;br/&gt;(c) establishes the limit of liability without proof of fault or negligence at no less than one billion dollars for companies that operate pipelines that have the capacity to transport at least 250,000 barrels of oil per day and at an amount prescribed by regulation for companies that operate any other pipelines;&lt;br/&gt;(d) requires that companies that operate pipelines maintain the financial resources necessary to pay the amount of the limit of liability that applies to them;&lt;br/&gt;(e) authorizes the National Energy Board to order any company that operates a pipeline from which an unintended or uncontrolled release of oil, gas or any other commodity occurs to reimburse any government institution the costs it incurred in taking any action or measure in relation to that release;&lt;br/&gt;(f) requires that companies that operate pipelines remain responsible for their abandoned pipelines;&lt;br/&gt;(g) authorizes the National Energy Board to order companies that operate pipelines to maintain funds to pay for the abandonment of their pipelines or for their abandoned pipelines;&lt;br/&gt;(h) allows the Governor in Council to authorize the National Energy Board to take, in certain circumstances, any action or measure that the National Energy Board considers necessary in relation to an unintended or uncontrolled release of oil, gas or any other commodity from a pipeline;&lt;br/&gt;(i) allows the Governor in Council to establish, in certain circumstances, a pipeline claims tribunal whose purpose is to examine and adjudicate the claims for compensation for compensable damage caused by an unintended or uncontrolled release of oil, gas or any other commodity from a pipeline;&lt;br/&gt;(j) authorizes, in certain circumstances, that funds may be paid out of the Consolidated Revenue Fund to pay the costs of taking the actions or measures that the National Energy Board considers necessary in relation to an unintended or uncontrolled release of oil, gas or any other commodity from a pipeline, to pay the costs related to establishing a pipeline claims tribunal and to pay any amount of compensation that such a tribunal awards; and&lt;br/&gt;(k) authorizes the National Energy Board to recover those funds from the company that operates the pipeline from which the release occurred and from companies that operate pipelines that transport a commodity of the same class as the one that was released.&lt;/div&gt;</ShortLegislativeSummaryEn>

Les membres du public peuvent en obtenir un exemplaire auprès du Service de renseignements de la Bibliothèque du Parlement.&lt;br/&gt;&lt;br/&gt;Le 8 décembre 2014, le ministre des Ressources naturelles et ministre de l'Initiative fédérale du développement économique dans le Nord de l’Ontario a déposé le projet de loi C-46, Loi modifiant la Loi sur l’Office national de l’énergie et la Loi sur les opérations pétrolières au Canada (Loi sur la sûreté des pipelines), à la Chambre des communes en première lecture.&lt;br/&gt;&lt;br/&gt;Projet de loi C-46 modifie la Loi sur l’Office national de l’énergie et la Loi sur les opérations pétrolières au Canada afin d’accroître la sûreté et la sécurité des pipelines régis par ces lois.&lt;br/&gt;Plus précisément, le texte vise notamment à :&lt;br/&gt;a) renforcer le principe du pollueur-payeur;&lt;br/&gt;b) confirmer que la responsabilité des compagnies exploitant des pipelines est illimitée lorsqu’un rejet non intentionnel ou non contrôlé de pétrole, de gaz ou de tout autre produit de ces pipelines est attribuable à leur faute ou négligence;&lt;br/&gt;c) établir la limite de responsabilité en l’absence de preuve de faute ou de négligence à au moins un milliard de dollars pour les compagnies exploitant des pipelines ayant la capacité de transporter au moins deux cent cinquante mille barils de pétrole par jour et au montant prévu par règlement pour celles exploitant tout autre pipeline;&lt;br/&gt;d) exiger que les compagnies exploitant des pipelines disposent des ressources financières nécessaires pour payer un montant correspondant à la limite de responsabilité qui leur est applicable;&lt;br/&gt;e) autoriser l’Office national de l’énergie à ordonner à toute compagnie exploitant un pipeline qui a provoqué un rejet non intentionnel ou non contrôlé de pétrole, de gaz ou de tout autre produit de rembourser toute institution gouvernementale des coûts qu’elle a supportés pour les mesures qu’elle a prises à l’égard de ce rejet;&lt;br/&gt;f) prévoir que les compagnies exploitant des pipelines demeurent responsables de leurs pipelines abandonnés;&lt;br/&gt;g) autoriser l’Office national de l’énergie à ordonner aux compagnies exploitant des pipelines de disposer de fonds pour payer pour la cessation d’exploitation de leurs pipelines ou pour leurs pipelines abandonnés;&lt;br/&gt;h) permettre au gouverneur en conseil d’autoriser l’Office national de l’énergie à prendre, dans certains cas, les mesures que ce dernier estime nécessaires relativement à un rejet non intentionnel ou non contrôlé de pétrole, de gaz ou de tout autre produit d’un pipeline;&lt;br/&gt;i) permettre au gouverneur en conseil de constituer, dans certains cas, un tribunal ayant pour mission d’examiner les demandes d’indemnisation relatives aux dommages indemnisables causés par un rejet non intentionnel ou non contrôlé de pétrole, de gaz ou de tout autre produit d’un pipeline et de les régler;&lt;br/&gt;j) autoriser, dans certains cas, le prélèvement de sommes sur le Trésor pour l’exécution de mesures que l’Office national de l’énergie juge nécessaires relativement à un rejet non intentionnel ou non contrôlé de pétrole, de gaz ou de tout autre produit d’un pipeline, pour la constitution d’un tribunal d’indemnisation en matière de pipelines et pour le paiement de toute indemnité accordée par un tel tribunal;&lt;br/&gt;k) autoriser l’Office national de l’énergie à récupérer les sommes ainsi prélevées de la compagnie qui exploite le pipeline ayant provoqué le rejet et de celles qui exploitent des pipelines transportant un produit de la même catégorie que celui qui a été rejeté.&lt;/div&gt;</ShortLegislativeSummaryFr>
