On 26 February 2009, the Minister of Justice and Attorney General of Canada introduced Bill C-14, An Act to amend the Criminal Code (organized crime and protection of justice system participants) in the House of Commons and it was given first reading. The bill amends the Criminal Code by: • making murders connected to organized crime activity automatically first-degree murders, regardless of whether it is planned and deliberate. First-degree murder is subject to a mandatory sentence of life imprisonment without eligibility for parole for 25 years; • creating offences for intentionally discharging a firearm while being reckless about endangering the life or safety of another person (meant to punish “drive-by” and other reckless shootings). • creating an offence for assaulting a peace officer with a weapon or causing bodily harm and of aggravated assault of a peace officer. This offence would carry a mandatory minimum sentence of four years in prison, with a maximum of 14 years. The minimum sentence would increase if the offence was committed for a criminal organization or with a prohibited or restricted firearm such as a handgun; and • to extend the duration of a recognizance to up to two years for a person who it is suspected will commit a criminal organization offence, a terrorism offence or an intimidation offence if they were previously convicted of such an offence, and to clarify that the recognizance may include conditions such as electronic monitoring. Le projet de loi a alors été lu pour la première fois. Le projet de loi apporte les modifications suivantes au Code criminel : • il fait en sorte que les meurtres qui sont liés à une organisation criminelle soient considérés comme des meurtres au premier degré, indépendamment de toute préméditation. Les meurtres au premier degré s’accompagnent d’une peine obligatoire d’emprisonnement à vie sans possibilité de libération conditionnelle avant 25 ans; • il érige en infraction le fait de décharger intentionnellement une arme à feu sans se soucier de la vie ou de la sécurité d’autrui (cette disposition cible les fusillades au volant et les autres fusillades dangereuses); • il érige en infraction le fait de commettre une agression armée contre un agent de la paix ou de lui infliger des lésions corporelles et de commettre des voies de fait graves à son endroit. Cette infraction s’accompagnerait d’une peine obligatoire d’emprisonnement d’au moins quatre ans et ne dépassant pas 14 ans. Une peine minimale plus sévère est prévue si l’infraction est commise pour le compte d’une organisation criminelle ou à l’aide d’une arme à feu prohibée ou à autorisation restreinte comme une arme de poing; • il porte à deux ans la durée maximale d’un engagement visant une personne dont on soupçonne qu’elle commettra une infraction d’organisation criminelle, une infraction de terrorisme ou une infraction d’intimidation dans le cas où la personne a déjà été condamnée pour une telle infraction et en précisant que cet engagement peut être assorti de conditions telles que la surveillance à distance.
