Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 63 of the Immigration and Refugee Protection Act is amended by adding the following after subsection (4):
|
|
|
|

Right to appeal — visa refusal
|
|
(4.1) A foreign national may appeal to the Immigration Appeal Division against a decision not to issue the foreign national a permanent resident visa if the decision is based on a finding that
|
|
|
|
(a) the foreign national is inadmissible on health grounds under paragraph 38(1)(c); or
|
|
|
|
(b) the foreign national is inadmissible under section 42 on grounds that a family member of the foreign national is inadmissible on health grounds under paragraph 38(1)(c).
|
|
|
|
(4.1) L’étranger peut interjeter appel de la décision de refuser de délivrer le visa de résident permanent qui est fondée sur l’un des motifs suivants :
|
|

|
a) il est interdit de territoire pour motifs sanitaires au titre du paragraphe 38(1) du fait que son état de santé risquerait d’entraîner un fardeau excessif pour les services sociaux ou de santé;
|
|
|
|
b) il est interdit de territoire aux termes de l’article 42 parce qu’un membre de sa famille est interdit de territoire pour motifs sanitaires au titre du paragraphe 38(1) du fait que son état de santé risquerait d’entraîner un fardeau excessif pour les services sociaux ou de santé.

Coming into force
|
|
2. This Act comes into force 30 days after the day on which it receives royal assent.
|
|
|
|
2. La présente loi entre en vigueur trente jours après sa sanction.
|
