SUMMARY This enactment amends the obligations set out in section 34 of the Quarantine Act that apply to the operators of certain conveyances arriving in or departing from Canada. Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 34 of the Quarantine Act is replaced by the following:

Quarantine Act

Clause 1: Existing text of section 34:

34. (1) Before arriving in Canada, the operator of a conveyance used in a business of carrying persons or cargo, or of any prescribed conveyance, shall report to the authority designated under paragraph 63(b) situated at the nearest entry point any reasonable grounds to suspect that

(a) any person, cargo or other thing on board the conveyance could cause the spreading of a communicable disease listed in the schedule;

(b) a person on board the conveyance has died; or

(2) Before departing from Canada through a departure point, the operator shall report to the authority designated under paragraph 63(b) situated at the departure point any circumstance referred to in paragraphs (1)(a) to (c) that exists.

(3) If it is not possible for the operator to report before their arrival in or departure from Canada, the report shall be made at the entry or departure point, as the case may be.

(4) The authority shall notify a quarantine officer or an environmental health officer without delay of any report received under this section.

Article 1 : Texte de l’article 34 :

34. (1) Le conducteur du véhicule servant à l’exploitation d’une entreprise de transport de personnes ou de marchandises ou de tout véhicule visé par règlement avise, avant son arrivée au Canada, l’autorité désignée en vertu de l’alinéa 63b) située au point d’entrée le plus proche de tout motif raisonnable qu’il a de soupçonner qu’une personne, les marchandises ou toute autre chose à bord de son véhicule risquent de propager une maladie transmissible inscrite à l’annexe, qu’une personne à bord de son véhicule est décédée ou qu’une circonstance prévue par règlement existe.

(2) Le conducteur avise, avant de quitter le Canada par un point de sortie, l’autorité désignée située à ce point de sortie de l’existence de toute circonstance visée au paragraphe (1).

(3) S’il lui est impossible de donner l’avis avant son arrivée au point d’entrée ou de sortie, le conducteur le fait dès qu’il arrive au point d’entrée ou de sortie.

(4) L’autorité désignée informe sans délai l’agent de quarantaine ou l’agent d’hygiène du milieu de tout avis reçu.

Application		34. (1) This section applies to the operator of any of the following conveyances:
		(a) a watercraft or aircraft that is used in the business of carrying persons or cargo; and
		(b) a prescribed conveyance.

Operator to inform quarantine officer before arrival		(2) As soon as possible before a conveyance arrives at its destination in Canada, the operator shall inform a quarantine officer or cause a quarantine officer to be informed of any reasonable grounds to suspect that
		(a) any person, cargo or other thing on board the conveyance could cause the spreading of a communicable disease listed in the schedule;
		(b) a person on board the conveyance has died; or
		(c) any prescribed circumstances exist.

(2) Dès que possible avant l’arrivée du véhicule à sa destination au Canada, le conducteur avise ou fait aviser l’agent de quarantaine de tout motif raisonnable qu’il a de soupçonner l’existence de l’un ou l’autre des faits suivants :		Avis : arrivée au Canada
a) une personne, des marchandises ou toute autre chose à bord du véhicule risquent de propager une maladie transmissible inscrite à l’annexe;
b) une personne à bord du véhicule est décédée;

Operator to inform quarantine officer before departure

(3) As soon as possible before a conveyance departs from Canada through a departure point, the operator shall inform a quarantine officer or cause a quarantine officer to be informed of any circumstance referred to in paragraphs (2)(a) to (c) that exists.

(3) Dès que possible avant que le véhicule quitte le Canada par un point de sortie, le conducteur avise ou fait aviser l’agent de quarantaine de l’existence de tout fait visé aux alinéas (2)a) à c).

Exception

(4) No operator contravenes subsection (2) if it is not possible for the operator to inform a quarantine officer or cause a quarantine officer to be informed before the conveyance’s arrival at its destination in Canada, as long as the operator does so on the conveyance’s arrival at that destination.

(4) Le conducteur ne contrevient pas au paragraphe (2) s’il lui est impossible de donner ou de faire donner l’avis avant l’arrivée du véhicule à sa destination au Canada pourvu qu’il le fasse dès l’arrivée de celui-ci à cette destination.

2. Section 63 of the Act is replaced by the following:

63. The Minister may make regulations

(a) amending the schedule by adding, deleting or amending the name of any communicable disease; and

(b) designating the authority to whom operators of conveyances shall report when arriving in or departing from Canada.

a) modifier l’annexe pour y ajouter, en retrancher ou y changer le nom d’une maladie transmissible;

b) désigner l’autorité qui doit être avisée par le conducteur à son arrivée au Canada ou départ du Canada.

63. The Minister may make regulations amending the schedule by adding, deleting or amending the name of any communicable disease.

Every person who contravenes subsection 6(2), 8(1) or 34(1), (2) or (4), section 36 or 38, subsection 42(1), section 45 or 50, subsection 54(3), section 58 or 59 or subsection 73(2) or the regulations is guilty of an offence and liable on summary conviction to a fine of not more than $750,000 or to imprisonment for a term of not more than six months, or to both.

4. The schedule to the Act is amended by replacing the section references after the heading “SCHEDULE” with the following:

Coming into force

5. Despite section 84 of the Quarantine Act, section 34 of that Act, as enacted by section 1 of this Act, comes into force on the day on which this Act receives royal assent.

5. Malgré l’article 84 de la Loi sur la mise en quarantaine, l’article 34 de cette loi, édicté par l’article 1 de la présente loi, entre en vigueur à la date de sanction de la présente loi.
