SUMMARY

This enactment amends the Criminal Code to create a separate offence in respect of the theft and possession of property that is of cultural or religious significance.

An Act to amend the Criminal Code (theft of property of cultural or religious significance)

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Criminal Code

1Paragraph (a) of the definition offence in section 183 of the Criminal Code is amended by adding the following after subparagraph (liv.‍3):

2The Act is amended by adding the following after section 333.‍2:

Theft of cultural or religious property

333.‍3(1)Everyone who commits theft is, if the property stolen is of cultural or religious significance, guilty of
  • (a)an indictable offence and liable to imprisonment for a term of not more than 10 years; or

  • (b)an offence punishable on summary conviction.

Possession of cultural or religious property

Start of inserted block
(2)Every person who, without lawful excuse, has in their possession property of cultural or religious significance in respect of which an offence has been committed under subsection (1) is guilty of
  • (a)an indictable offence and liable to imprisonment for a term of not more than five years; or

  • (b)an offence punishable on summary conviction.
