SOMMAIRE
Le texte modifie le Code criminel afin d’exiger du tribunal qu’il considère comme circonstance aggravante pour la détermination de la peine le fait que la victime de voies de fait est un travailleur de la santé.
SUMMARY
This enactment amends the Criminal Code to require a court to consider the fact that the victim of an assault is a health care worker to be an aggravating circumstance for the purposes of sentencing.

1 Le Code criminel est modifié par adjonction, après l’article 269.01, de ce qui suit :
1 The Criminal Code is amended by adding the following after section 269.01:
Circonstance aggravante — voies de fait contre un travailleur de la santé
Aggravating circumstance — assault against a health care worker
269.02 (1) Le tribunal qui détermine la peine à infliger à l’égard d’une infraction prévue à l’alinéa 264.1(1)a) ou à l’un des articles 266 à 269 est tenu de considérer comme circonstance aggravante le fait que la victime est un travailleur de la santé qui exerçait ses fonctions au moment de la perpétration de l’infraction.
End of inserted block269.02 (1) When a court imposes a sentence for an offence referred to in paragraph 264.1(1)(a) or any of sections 266 to 269, it shall consider as an aggravating circumstance the fact that the victim of the offence was, at the time of the commission of the offence, a health care worker engaged in the performance of their duty.

Definition of health care worker
(2) Pour l’application du paragraphe (1), travailleur de la santé s’entend de toute personne qui travaille dans un milieu de soins de santé, notamment un hôpital, un établissement résidentiel, une clinique, une pharmacie ou la résidence d’une personne qui reçoit des soins à domicile.
End of inserted block(2) For the purposes of subsection (1), health care worker includes any individual employed in a health care setting such as a hospital, residential facility, treatment clinic, pharmacy or the home of a person receiving home care.
