SOMMAIRE
Le texte modifie la Loi sur la procréation assistée afin de décriminaliser la rétribution des donneurs de spermatozoïdes ou d’ovules et des mères porteuses. Il précise que, sous réserve de l’article 9, les donneurs de spermatozoïdes ou d’ovules ne doivent pas avoir moins de dix-huit ans, être incapables de consentir au don et être forcés à faire le don. Il précise également que les mères porteuses ne doivent pas avoir moins de vingt et un ans, être incapables de consentir à devenir mère porteuse et être forcées à le devenir.
Le texte modifie également la même loi afin de permettre l’achat d’autre matériel reproductif humain.
SUMMARY
This enactment amends the Assisted Human Reproduction Act to decriminalize payment for sperm or ovum donation and for surrogacy. It specifies that, subject to section 9, a sperm or ovum donor must be at least 18 years of age, must have the capacity to consent to the donation and must not be coerced into donating. It also specifies that a surrogate mother must be at least 21 years of age, must have the capacity to consent to becoming a surrogate mother and must not be coerced into becoming a surrogate mother.
The enactment also amends the Act to allow for the purchase of other human reproductive material.

1 Section 2 of the Assisted Human Reproduction Act is amended by adding “and” at the end of paragraph (e) and by repealing paragraph (f).

End of inserted block7 (1) Subject to section 9, no person shall counsel or induce a person to donate their sperm or ova, or perform any medical procedure to assist a person to donate their sperm or ova, knowing or having reason to believe that the person is under 18 years of age, is incapable of consenting to the donation or is being coerced by a third party to donate.

12 (1) Il est interdit, sauf en conformité avec les règlements, de rembourser les frais supportés par quiconque pour l’entretien ou le transport d’un embryon in vitro.
12 (1) No person shall, except in accordance with the regulations, reimburse any person for an expenditure incurred in the maintenance or transport of an in vitro embryo.
(2) Le paragraphe 12(3) de la même loi est abrogé.

5 L’alinéa 65(1)e.1) de la même loi est abrogé.
