SOMMAIRE
Le texte modifie la Loi sur les juges afin de préciser que, dans certains cas, pour être nommée juge d’une juridiction supérieure d’une province, une personne doit parler clairement et bien comprendre les deux langues officielles.
SUMMARY
This enactment amends the Judges Act to specify that, in certain cases, in order to be appointed as a judge of the superior court of a province, a person must be able to speak clearly in and fully understand both official languages.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 La Loi sur les juges est modifiée par adjonction, après l’article 3, de ce qui suit :
1 The Judges Act is amended by adding the following after section 3:
Bilinguisme — désignation de postes
Bilingualism — designation of positions
4 (1) Le poste désigné bilingue par le procureur général de la province doit être pourvu par une personne qui, en plus de respecter les critères prévus à l’article 3, parle clairement et comprend bien les deux langues officielles.
End of inserted block4 (1) A position designated bilingual by the attorney general of the province must be filled by a person who, in addition to meeting the criteria set out in section 3, is able to speak clearly in and fully understand both official languages.

(2) Le juge en chef de la juridiction supérieure de la province peut demander qu’un poste donné soit pourvu par une personne qui, en plus de respecter les critères prévus à l’article 3, parle clairement et comprend bien les deux langues officielles.

(3) Le Bureau du commissaire à la magistrature fédérale évalue le niveau de compétence de la personne dans les deux langues officielles.
