SOMMAIRE
Le texte modifie la Loi sur les transports au Canada afin de limiter, certains jours ou à certains moments, le bruit et les vibrations produits par la construction ou l’exploitation d’un chemin de fer situé à proximité d’établissements résidentiels, institutionnels ou commerciaux.
SUMMARY
This enactment amends the Canada Transportation Act to control noise and vibrations produced by the construction or operation of railways located in close proximity to residential, institutional or commercial establishments at certain times or on certain days.

2 La Loi sur les transports au Canada est modifiée par adjonction, après l’article 95.1, de ce qui suit :
2 The Canada Transportation Act is amended by adding the following after section 95.1:

95.11 (1) Il est interdit à la compagnie de chemin de fer qui construit ou exploite un chemin de fer dans un rayon de trois cents mètres d’un établissement résidentiel, institutionnel ou commercial, d’effectuer des manœuvres, d’atteler ou de dételer des wagons ou de laisser fonctionner une locomotive au ralenti pendant les heures ou les jours suivants :
-
a) le samedi, le dimanche et les jours fériés;
-
b) avant 8 h ou après 22 h les autres jours.

95.11 (1) A railway company constructing or operating a railway within 300 metres of any residential, institutional or commercial establishment shall not shunt, couple or decouple cars or leave an engine with its motor idling
-
(a) at any time on a Saturday, Sunday, or legal holiday; and
-
(b) before 8:00 a.m. and after 10:00 p.m. on any other day.

(2) En cas de situation de crise nationale au sens de l’article 3 de la Loi sur les mesures d’urgence, le ministre peut autoriser la tenue des activités visées au paragraphe (1) pour une période qu’il désigne.
End of inserted block(2) During a national emergency within the meaning of section 3 of the Emergencies Act, the Minister may authorize the activities referred to in subsection (1) to take place for a period determined by the Minister.

95.3 (1) Sur réception d’une plainte selon laquelle une compagnie de chemin de fer ne se conforme pas à l’article 95.1 Insertion start ou au paragraphe 95.11(1) Insertion end , l’Office peut ordonner à celle-ci de prendre les mesures qu’il estime raisonnables pour assurer qu’elle Insertion start s’y Insertion end conforme.
95.3 (1) On receipt of a complaint made by any person that a railway company is not complying with section 95.1 Insertion start or subsection 95.11(1) Insertion end , the Agency may order the railway company to undertake any changes in its railway construction or operation that the Agency considers reasonable to ensure compliance with that section Insertion start or subsection Insertion end .
