Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|
|
|
|

1. Section 3 of the Corrections and Conditional Release Act is amended by striking out “and” at the end of paragraph (a), by adding “and” at the end of paragraph (b) and by adding the following after paragraph (b):
|
|
|
|

|
|
|
|
(c) encouraging the accountability and responsibility of offenders, with a view to ensuring that their obligations to society are addressed.
|
|
|
|
3. Le système correctionnel vise à contribuer au maintien d’une société juste, vivant en paix et en sécurité :
|
|
|
|
a) en assurant l’exécution des peines par des mesures de garde et de surveillance sécuritaires et humaines;
|
|
|
|
b) en aidant, au moyen de programmes appropriés dans les pénitenciers ou dans la collectivité, à la réadaptation des délinquants et à leur réinsertion sociale à titre de citoyens respectueux des lois;
|
|
|
|
c) en encourageant la responsabilisation des délinquants afin qu’ils s’acquittent de leurs obligations envers la société.

2. The Act is amended by adding the following after section 78:
|
|

|
Monetary awards to offenders
|
|
78.1 (1) In view of the purpose of the federal correctional system referred to in paragraph 3(c), any monetary amount awarded to an offender by a court, pursuant to a legal action or proceeding, shall be paid by that court in equal shares to the following persons
|
|
|
|
(a) firstly, to every person whom a court has ordered to be paid any sum as part of a restitution order made against the offender;
|
|
|
|
(b) secondly, if there is no person described in paragraph (a), to every beneficiary of an unpaid spousal or child support award that has been made against the offender; and
|
|
|
|
(c) thirdly, if there is no person described in paragraph (a) or (b), to every beneficiary of a civil judgment against the offender.
|

|
|
78.1 (1) Pour favoriser la réalisation du but du système correctionnel énoncé à l’alinéa 3c), le tribunal qui accorde une indemnité à un délinquant dans le cadre d’une action ou d'une poursuite en justice la verse en parts égales aux personnes suivantes :

a) chaque bénéficiaire d’une ordonnance de dédommagement rendue par un tribunal contre le délinquant;
|
|
|
|
b) en cas d’inapplication de l’alinéa a), chaque bénéficiaire à qui le délinquant doit des aliments en vertu d’une ordonnance alimentaire rendue contre lui au profit d’un époux ou d’un enfant;
|
|
|
|
c) en cas d’inapplication des alinéas a) et b), chaque bénéficiaire d’un jugement civil rendu contre le délinquant.

|
|
Victims’ groups
|
|
(2) If there are no persons described in paragraphs (a), (b) or (c), the court shall pay out the monetary amount to a victims’ group or other group or organization with a special interest in matters relating to victims.
|
|
|
|
(2) En l’absence de bénéficiaires visés au paragraphe (1), le tribunal verse l’indemnité à un groupe de soutien aux victimes ou à tout autre groupe ou association intéressé aux questions touchant les victimes.
