SUMMARY

This enactment amends the mental disorder regime in the Criminal Code and the National Defence Act to specify that the paramount consideration in the decision-making process is the safety of the public and to create a scheme for finding that certain persons who have been found not criminally responsible on account of mental disorder are high-risk accused. It also enhances the involvement of victims in the regime and makes procedural and technical amendments.

Le texte modifie le cadre législatif applicable aux troubles mentaux dans le Code criminel et la Loi sur la défense nationale afin de préciser que la sécurité du public est le facteur prépondérant dans le processus décisionnel. Il crée un mécanisme afin de prévoir que certaines personnes qui reçoivent un verdict de non-responsabilité criminelle pour cause de troubles mentaux peuvent être déclarées des accusés à haut risque et il accroît la participation des victimes. Il apporte aussi des modifications de nature technique ou administrative.
