SUMMARY
This enactment amends the Criminal Code to provide that a first offence for motor vehicle theft will be proceeded with by either summary conviction or by indictment while a second or subsequent offence will be proceeded with by indictment.

An Act to amend the Criminal Code (motor vehicle theft)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Criminal Code is amended by adding the following after section 334:
Punishment for motor vehicle theft
334.1 Every one who commits theft of a motor vehicle is
(a) in the case of a first offence,
(i) guilty of an offence punishable on summary conviction, or
(ii) guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; and
(b) in the case of a second or subsequent offence, guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.
