An Act to amend the Canada Marine Act (City of Toronto) and other Acts in consequence
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1998, c. 10
CANADA MARINE ACT
1. Section 55 of the Canada Marine Act is amended by adding the following after subsection (5):
Toronto Port Authority dissolved
(6) The Toronto Port Authority is dissolved and all its assets, rights and obligations are transferred to the City of Toronto. In particular,
(a) the corporate name of the City of Toronto is substituted for that of the Toronto Port Authority in every contract, collective agreement, lease, licence, permit or other document entered into or granted by the Toronto Port Authority with regard to the port;
(b) the management of the federal real property and federal immovables that were under the control of the Toronto Port Authority, and any rights related to them, is conferred on the City of Toronto;
(c) the real property and immovables, other than federal real property and federal immovables, that the Toronto Port Authority occupied or the title to which it held, whether or not in its own name, and any rights related to them, become the interest, property and rights of the City of Toronto, as the case may be;
(d) the personal property, and any rights related to the property, that the Toronto Port Authority manages, or the title to which it holds, on behalf of Her Majesty in right of Canada, whether or not in its own name, become the property and rights of the City of Toronto;
(e) any existing cause of action, proceeding or claim by or against the Toronto Port Authority or a liability or other obligation of the Toronto Port Authority is unaffected except that any judgment or order is to be satisfied first by the City of Toronto;
(f) a civil, criminal or administrative action or proceeding pending by or against the Toronto Port Authority may be continued only by or against the City of Toronto; and
(g) subject to paragraph (e), a conviction against, or a ruling, order or judgment in favour of or against, the Toronto Port Authority may be enforced only by or against the City of Toronto.
2. Item 15 of Part 1 of the schedule to the Act is repealed.

COMING INTO FORCE
Coming into force
7. This Act comes into force 60 days after the day on which it receives royal assent.
