An Act to amend the Criminal Code (peace officers)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. (1) Subsection 235(1) of the Criminal Code is replaced by the following:
Punishment for murder
235. (1) Subject to subsection (3), every one who commits first degree murder or second degree murder is guilty of an indictable offence and shall be sentenced to imprisonment for life.
(2) Section 235 of the Act is amended by adding the following after subsection (2):
Punishment for murder of a peace officer
(3) For the purposes of Part XXIII, every one who commits first degree murder when the victim is a peace officer is guilty of an indictable offence and shall be sentenced to imprisonment for life without eligibility for parole.
2. Subsection 270(2) of the Act is replaced by the following:
Punishment
(2) Every one who commits an offence under subsection (1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years and to a minimum punishment of imprisonment for a term of four years.
3. Section 745 of the Act is amended by adding the following after paragraph (a):
(a.1) in respect of a person who has been convicted of first degree murder where the victim is a peace officer, that the person be sentenced to imprisonment for life without eligibility for parole;
4. Subsection 745.6(2) of the Act is replaced by the following:
Exceptions
(2) An application under subsection (1) may not be made by a person who has been convicted of
(a) more than one murder, whether or not proceedings were commenced in respect of any of the murders before another murder was committed; and
(b) first degree murder where the victim is a peace officer.
