SUMMARY
This enactment makes it an offence for a person to be in possession of or to transfer, without lawful excuse, any information or document that can be used to identify another person.

An Act to amend the Criminal Code (personal identity theft)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Criminal Code is amended by adding the following after section 355:
Possession or transfer of identifying information
355.1 (1) Every one commits an offence who, without lawful excuse, has in his or her possession or transfers any information that can be used to identify a person other than him or her.
Possession or transfer of identity documents
(2) Every one commits an offence who, without lawful excuse, has in his or her possession or transfers a document appearing to be issued for the purpose of identifying a person other than him or her, including a credit card, a birth certificate, a passport, a driver’s licence or a health insurance card.
Punishment
(3) Every one who commits an offence under subsection (1) or (2) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.
