An Act to prohibit the use of benzyl butyl phthalate (BBP), dibutyl phthalate (DBP) and di(2-ethylhexyl)phthalate (DEHP) in certain products and to amend the Canadian Environmental Protection Act, 1999
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
Short title
1. This Act may be cited as the Phthalate Control Act.
INTERPRETATION
Definition of “Minister”
2. In this Act , “Minister” means the Minister of the Environment.
REGULATIONS
Regulations
3. The Minister shall, within 12 months after the coming into force of this Act, make regulations prohibiting the use of
(a) benzyl butyl phthalate (BBP) with respect to
(i) products for use by a child in learning or play, and
(ii) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products;
(b) dibutyl phthalate (DBP) with respect to
(i) cosmetics,
(ii) products for use by a child in learning or play, and
(iii) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products; and
(c) di(2-ethylhexyl)phthalate (DEHP) with respect to
(i) cosmetics,
(ii) medical devices, other than blood bags,
(iii) products for use by a child in learning or play, and
(iv) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products.

AMENDMENTS TO THE CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999
4. Schedule 1 to the Canadian Environmental Protection Act, 1999 is amended by adding the following in numerical order:
80. Benzyl butyl phthalate (BBP)
81. Dibutyl phthalate (DBP)
82. Di(2-ethylhexyl)phthalate (DEHP)
