Bill C-27

SUMMARY

This enactment provides statutory authority respecting the inspection powers of the Canadian Food Inspection Agency and the enforcement of Acts under its responsibility. It authorizes a number of measures such as

(a) subjecting various activities related to the importation and exportation of, and interprovincial trade in, regulated products, to a licensing regime;

(b) prohibiting, licensing or permitting certain activities related to dangerous things that are subject to the Health of Animals Act or the Plant Protection Act such as pathogens;

(c) permitting the exchange of information with other governmental authorities or prescribed organizations;

(d) permitting the Agency to enter into arrangements in respect of foreign inspections; and

(e) modernizing powers of inspection.

In addition, it creates certain new offences related to those measures as well as offences related to tampering with a regulated product.

It also authorizes the Minister to make orders to respond to natural disasters or urgent situations.

Finally, the enactment amends certain other Acts in consequence.

SOMMAIRE

Le texte prévoit les pouvoirs d’inspection de l’Agence canadienne d’inspection des aliments et de contrôle d’application des lois relevant d’elle. Il prévoit notamment les mesures suivantes :

a) l’assujettissement, à un régime de licences, d’activités reliées à l’importation, à l’exportation et au commerce interprovincial de produits réglementés;

b) la délivrance de licences et de permis pour l’exercice de certaines activités relatives à des produits ou agents dangereux, tels les agents pathogènes, visés par la Loi sur la santé des animaux ou la Loi sur la protection des végétaux, ou l’interdiction de telles activités;

c) l’échange d’information avec des autorités publiques ou des organisations réglementaires;

d) la conclusion, par l’Agence, d’accords d’inspection avec l’étranger;

e) la modernisation des pouvoirs d’inspection.

Il crée de nouvelles infractions, reliées notamment à ces mesures ainsi qu’à l’altération de produits réglementés.

Il autorise le ministre à prendre des arrêtés pour répondre à une situation d’urgence ou à une catastrophe naturelle.

Il apporte enfin des modifications corrélatives à d’autres lois.
