Summary
This enactment amends the Royal Canadian Mounted Police Act to provide for a comprehensive system for the certification of a police association composed of members of the Royal Canadian Mounted Police and for collective bargaining rights. It also eliminates the External Review Committee and creates a new regime respecting grievances with a right to refer all disciplinary matters not resolved by the grievance process to adjudication.
The enactment replaces Parts II and III of the Act with a new Part II. Division I of the new Part II establishes the Public Service Staff Relations Board as the competent body for dealing with certain matters related to labour relations between the employer and the employees.
Division II deals with the certification of bargaining agents and the negotiation of collective agreements.
Division III sets out a dispute resolution process where the parties have failed to reach agreement in their collective bargaining.
Division IV replaces the existing grievance regime and also makes available adjudication services to be provided by the Public Service Staff Relations Board.
Division V includes provisions that prohibit a strike by employees and provide for an offence on summary conviction for breaching this prohibition.
The enactment also makes consequential changes to other Parts of the Act.
