An Act to amend the Canadian Human Rights Act

R.S., c. H-6

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 5 of the Canadian Human Rights Act is renumbered as subsection 5(1) and is amended by adding the following:

Denial due to assistance dog

(2) For greater certainty and despite any other provision of this Act, it is a discriminatory practice under subsection (1) to

    (a) deny an individual access to goods, services, facilities or accommodation that are customarily available to the general public by prohibiting the entry of the individual's assistance dog into the area where such goods, services, facilities or accommodation are accessible, unless the prohibition is clearly necessary to protect public health or safety; or

    (b) deny the trainer of a dog that is being trained to be an assistance dog access to any area where goods, services, facilities or accommodation that are customarily available to the general public by prohibiting the entry of the dog into any such area, unless the prohibition is clearly necessary to protect public health or safety.

2. Section 6 of the Act is renumbered as subsection 6(1) and is amended by adding the following:

Denial due to assistance dog

(2) For greater certainty, it is a discriminatory practice under subsection (1) to deny an individual occupancy of commercial premises or residential accommodation because that individual uses an assistance dog.

3. Section 25 of the Act is amended by adding the following in alphabetical order:

``assistance dog''
« chien aidant »

``assistance dog'' means a dog that has been fully trained by a qualified animal trainer as a seeing-eye dog, a service dog, a seizure response dog or a seizure alert dog;
