An Act to amend the Canadian Security Intelligence Service Act (recommendations of the Review Committee)

R.S., c. C-23; R.S., c. 1 (4th Supp.); 1993, c. 34; 1995, c. 5; 1996, c. 18

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Canadian Security Intelligence Service Act is amended by adding the following after section 52:

Recommen-
dations to be implemented

52.1 (1) Where a recommendation is made pursuant to section 52 that relates to the Service or to an organization mentioned in section 29, the Director or the deputy head concerned shall implement the recommendation as soon as practicable after the expiry of thirty days after receiving the recommendation unless, within the thirty days, the Minister has overruled the recommendation.

Report to Parliament

(2) Where the Minister overrules a recommendation, the Minister shall cause to be laid before both Houses of Parliament, within twenty sitting days of so doing, a report giving the reasons for overruling the recommendation, unless the Minister is of the opinion that the reasons must not be disclosed because of security, in which case the report shall state why they must not be disclosed.
