23. The definition ``Minister'' in section 2 of the Historic Sites and Monuments Act is replaced by the following:

24. Paragraph 4(1)(c) of the Act is replaced by the following:

6. (1) The Minister may designate an officer of the Department of Canadian Heritage to be the Secretary of the Board, or appoint a Secretary of the Board at such remuneration and under such terms or conditions of employment as may be prescribed by the Governor in Council.

Other staff

(2) The Minister may, from among the persons employed in the Department of Canadian Heritage, provide the Board with such other employees or assistants as are necessary for the proper conduct of the business of the Board.

27. Section 42 of the Official Languages Act is replaced by the following:

42. The Minister of Canadian Heritage, in consultation with other ministers of the Crown, shall encourage and promote a coordinated approach to the implementation by federal institutions of the commitments set out in section 41.

28. (1) The portion of subsection 43(1) of the Act before paragraph (a) is replaced by the following:

29. Section 44 of the Act is replaced by the following:

Annual report to Parliament

44. The Minister of Canadian Heritage shall, within such time as is reasonably practicable after the termination of each financial year, submit an annual report to Parliament on the matters relating to official languages for which that Minister is responsible.

30. Section 88 of the Act is replaced by the following:

Permanent review of Act, etc. by parliamen-

88. The administration of this Act, any regulations and directives made under this Act and the reports of the Commissioner, the President of the Treasury Board and the Minister of Canadian Heritage made under this Act shall be reviewed on a permanent basis by such committee of the Senate, of the House of Commons or of both Houses of Parliament as may be designated or established for that purpose.

Status of the Artist Act

38. (1) Subsection 4(1) of the Status of the Artist Act is replaced by the following:

4. (1) The Minister of Canadian Heritage shall establish a Canadian Council on the Status of the Artist, composed of seven to twelve part-time members, including a Chairperson, one or two Vice-chairpersons and not more than nine other members, to be appointed by the Governor in Council on the recommendation of the Minister and to hold office during pleasure of the Governor in Council.

(2) Paragraph 4(2)(a) of the Act is replaced by the following:

    (a) to provide information and advice to the Minister of Canadian Heritage in order to ensure the highest quality of decision-making in respect of artists in Canada;

(3) Subsection 4(3) of the English version of the Act is replaced by the following:

Report

(3) The Council shall submit to the Minister of Canadian Heritage, by May 31 of each year, a report of its activities during the previous fiscal year, including any studies that the Minister directed it to carry out.

39. Subsection 10(2) of the Act is replaced by the following:

Appointment

(2) The Governor in Council, on the recommendation of the Minister in consultation with the Minister of Canadian Heritage, shall appoint the members of the Tribunal to hold office during good behaviour, subject to removal by the Governor in Council for cause.

40. Subsection 13(1) of the Act is replaced by the following:

Head office

13. (1) The location of the head office of the Tribunal shall be fixed by the Governor in Council, on the recommendation of the Minister after consultation with the Minister of Canadian Heritage, and the Tribunal may establish any other offices that it considers necessary.

41. Section 56 of the Act is replaced by the following:

Regulations

56. On the recommendation of the Minister after consultation with the Minister of Canadian Heritage, the Governor in Council may make regulations prescribing anything that may be prescribed under any provision of this Part, and any other regulations that the Governor in Council considers necessary to carry out the provisions of this Part, other than regulations that may be made by the Tribunal under section 16.

42. Subsection 66(1) of the Act is replaced by the following:

Review of Act

66. (1) In the seventh year after the coming into force of this section, the Minister of Canadian Heritage, in consultation with the Minister, shall undertake a review of the provisions and operations of this Act and shall immediately submit to each House of Parliament a report thereon including a statement of any changes the Minister of Canadian Heritage would recommend.
