(<DefinedTermFr>première nation</DefinedTermFr>)</Text></Paragraph><Definition><Text><DefinedTermEn>First Nation law</DefinedTermEn> means</Text><Paragraph><Label>(a)</Label><Text>a bylaw made under the <XRefExternal reference-type="act" reference-level="federal">Indian Act</XRefExternal>;</Text></Paragraph></Definition><Paragraph><Label>(b)</Label><Text>a <Emphasis style="italic">First Nation law</Emphasis> as defined in subsection 2(1) of the<XRefExternal reference-type="act" reference-level="federal"> Framework Agreement on First Nation Land Management Act</XRefExternal>; or</Text></Paragraph><Paragraph><Label>(c)</Label><Text>a law enacted by a council, government or other entity that is authorized to act on behalf of a First <Keep>Nation</Keep> under a self-government agreement implemented by an Act of Parliament. (<DefinedTermFr>texte législatif de première nation</DefinedTermFr>)</Text></Paragraph></SectionPiece></AmendedText><ExplanatoryNote><TitleText><XRefExternal reference-type="act" reference-level="federal">Director of Public Prosecutions Act</XRefExternal> </TitleText><Label><Emphasis style="italic">Clause 1</Emphasis>:  (1)</Label><ExplanatoryText>New.</ExplanatoryText></ExplanatoryNote></Subsection><Subsection><Label>(2)</Label><Text><Emphasis style="bold">The definition of </Emphasis><DefinedTermEn>prosecution</DefinedTermEn><Emphasis style="bold"> in section 2 of the Act is replaced by the following: </Emphasis></Text><AmendedText><SectionPiece><Definition><Text><DefinedTermEn>prosecution</DefinedTermEn>, except in relation to matters referred to in subsection 3(8) <Ins>or section 3.1</Ins>, means a prosecution under the jurisdiction of the Attorney General, a proceeding <Keep>respecting</Keep> any offence, the prosecution — or prospective prosecution — of which is under the jurisdiction of the Attorney General, and any appeal related to such a prosecution or proceeding. (<DefinedTermFr>poursuite</DefinedTermFr>)</Text></Definition></SectionPiece></ExistingText></ExplanatoryNote></Subsection></Section><Section><MarginalNote>Duties — First Nation laws</MarginalNote><Label>2</Label><Text><Emphasis style="bold">The Act is amended by adding the following <Keep>after</Keep> section 3: </Emphasis></Text><AmendedText change="ins"><Section><Label>3.1</Label><Subsection><Label>(1)</Label><Text>Subject to subsection (2), the Director initiates and conducts prosecutions of summary conviction <Keep>offences</Keep> under First Nation laws, as well as any appeal or other proceeding related to such a prosecution, on behalf of the First Nation that made or enacted the First Nation law.</Text></Subsection></Section><Section><Label /><Subsection><MarginalNote>Exception</MarginalNote><Label>(2)</Label><Text>The Director shall not initiate or conduct a prosecution of a summary conviction offence under a First <Keep>Nation</Keep> law, or any appeal or other proceeding related to such a prosecution, if the First Nation that made or <Keep>enacted</Keep> the First Nation law has appointed or retained a prosecutor or entered into an agreement with a provincial or territorial government for the prosecution of <Keep>summary</Keep> conviction offences created by its First Nation laws.</Text></Subsection></Section></AmendedText><ExplanatoryNote><Label><Emphasis style="italic">Clause 2</Emphasis>: </Label><ExplanatoryText>New.</ExplanatoryText></ExplanatoryNote></Section></Body></Bill>
