<?xml version="1.0" encoding="utf-8"?><Bill bill-origin="commons" bill-type="private-public" xml:lang="en" date-time="2023-08-30 10:25:07"><Identification><BillNumber>C-355</BillNumber><Parliament><Session>1</Session><Number>44</Number><RegnalYear><Year-s>70-71</Year-s><Monarch>Elizabeth II – 1-2 Charles III</Monarch></RegnalYear><Year-s>2021-2022-2023-2024</Year-s></Parliament><LongTitle>An Act to prohibit the export by air of horses for slaughter and to make related amendments to certain Acts</LongTitle><ShortTitle status="unofficial">Prohibition of the Export of Horses by Air for Slaughter Act</ShortTitle><RunningHead>Prohibition of the Export of Horses by Air for Slaughter Act</RunningHead><BillHistory><Stages stage="third-reading-house"><Date><YYYY>2024</YYYY><MM>5</MM><DD>9</DD></Date></Stages></BillHistory><BillRefNumber date-time="2023-08-30">441277</BillRefNumber></Identification><Introduction><Summary><TitleText>SUMMARY</TitleText><Provision><Text>This enactment prohibits the export by air from Canada of live horses for the purpose of being slaughtered or fattened for slaughter.</Text></Provision></Summary><Preamble><Provision><MarginalNote>Preamble</MarginalNote><Text>Whereas, in Canada, a combination of robust federal and provincial laws ensures the humane treatment and handling of livestock and the protection of animal welfare;</Text></Provision><Provision><Text>Whereas, despite the strengthening of the regulatory requirements related to the humane transportation of animals in 2020, the export of live horses by air from Canada continues to raise concerns, particularly in relation to the welfare of horses that are exported for the purpose of being slaughtered or fattened for slaughter;</Text></Provision><Provision><Text>Whereas the export by air from Canada of horses for slaughter can involve long flights in cramped conditions;</Text></Provision><Provision><Text>Whereas horses experience significant stress during such flights and are at risk of injury because of their tendency to panic easily and their strong fight-or-flight response to fear and stress;</Text></Provision><Provision><Text>And whereas Parliament considers that it is desirable to address the risks related to the welfare of horses that are exported by air for slaughter;</Text></Provision></Preamble><Enacts><Provision><Text>Now, therefore, His Majesty, by and with the advice and consent <Keep>of the</Keep> Senate and House of Commons of Canada, <Keep>enacts</Keep> as follows:</Text></Provision></Enacts></Introduction><Body><Heading level="1"><TitleText>Short Title</TitleText></Heading><Section><MarginalNote>Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act">Prohibition of the Export of Horses by Air for Slaughter Act</XRefExternal>.</Text></Section><Heading level="1"><TitleText>Interpretation</TitleText></Heading><Section><MarginalNote>Definition of <DefinedTermEn>Minister</DefinedTermEn></MarginalNote><Label>2</Label><Text>In this Act, <DefinedTermEn>Minister</DefinedTermEn> means the Minister of Agriculture and Agri-Food.</Text></Section><Heading level="1"><TitleText>His Majesty</TitleText></Heading><Section><MarginalNote>Binding on His Majesty</MarginalNote><Label>3</Label><Text>This Act is binding on His Majesty in right of Canada or a province.</Text></Section><Heading level="1"><TitleText>Prohibitions</TitleText></Heading><Section><MarginalNote>Export of horse by air</MarginalNote><Label>4</Label><Text>It is prohibited for a person to export a horse from Canada by air unless they have, in the form and manner specified by the Minister, provided the Minister with a written declaration attesting that, to the best of their knowledge, the horse is not being exported for the purpose of being slaughtered or fattened for slaughter, or any other document that is satisfactory to the Minister, as well as with any other documentation that the Minister may require.</Text></Section><Section><MarginalNote>False or misleading information</MarginalNote><Label>5</Label><Text>It is prohibited for a person who submits a declaration under section 4 to provide false or misleading information or make a false or misleading statement in respect of the declaration or any matter related to the declaration.</Text></Section><Section><MarginalNote>Offence and punishment</MarginalNote><Label>6</Label><Text>A person who contravenes any provision of this Act is guilty of an offence and liable</Text><Paragraph><Label>(a)</Label><Text>on conviction on indictment, to a fine of not more than $250,000 or to imprisonment for a term of not more than two years, or to both; or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>on summary conviction, to a fine of not more than $50,000 or to imprisonment for a term of not more than six months, or to both.</Text></Paragraph></Section><Section><MarginalNote>Due diligence</MarginalNote><Label>7</Label><Text>A person is not to be found guilty of an offence under this Act if they establish that they exercised all due diligence to prevent its commission.</Text></Section><Heading level="1"><TitleText>Related Amendments</TitleText></Heading><Heading level="2"><MarginalNote><HistoricalNote>1997, c. 6</HistoricalNote></MarginalNote><TitleText>Canadian Food Inspection Agency Act</TitleText></Heading><Section type="amending"><Label>8</Label><Text>Subsection 11(1) of the <XRefExternal reference-type="act">Canadian Food Inspection Agency Act</XRefExternal> is replaced by the following:</Text><AmendedText><Section><MarginalNote>Administration and enforcement</MarginalNote><Label>11</Label><Subsection><Label>(1)</Label><Text>The Agency is responsible for the administration and enforcement of the <XRefExternal reference-type="act">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>, the <XRefExternal reference-type="act">Feeds Act</XRefExternal>, the <XRefExternal reference-type="act">Fertilizers Act</XRefExternal>, the <XRefExternal reference-type="act">Health of Animals Act</XRefExternal>, the <XRefExternal reference-type="act">Plant Breeders’ Rights Act</XRefExternal>, the <XRefExternal reference-type="act">Plant Protection Act</XRefExternal>, the <XRefExternal reference-type="act">Prohibition of the Export of Horses by Air for Slaughter Act</XRefExternal>, the <XRefExternal reference-type="act">Safe Food for Canadians Act</XRefExternal> and the <XRefExternal reference-type="act">Seeds Act</XRefExternal>.</Text></Subsection></Section></AmendedText></Section><Heading level="2"><MarginalNote><HistoricalNote>2005, c. 38</HistoricalNote></MarginalNote><TitleText>Canada Border Services Agency Act</TitleText></Heading><Section type="amending"><Label>9</Label><Text>Paragraph 9(2)(b) of the <XRefExternal reference-type="act">Canada Border Services Agency Act</XRefExternal> is replaced by the following:</Text><AmendedText><SectionPiece><Paragraph><Label>(b)</Label><Text>as an inspector or a veterinary inspector or other officer for the enforcement of any Act or instrument made under it, or any part of an Act or instrument, that the Governor in Council or Parliament authorizes the Minister, the Agency, the President or an employee of the Agency to enforce, including the <XRefExternal reference-type="act">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>, the <XRefExternal reference-type="act">Feeds Act</XRefExternal>, the <XRefExternal reference-type="act">Fertilizers Act</XRefExternal>, the <XRefExternal reference-type="act">Health of Animals Act</XRefExternal>, the <XRefExternal reference-type="act">Plant Protection Act</XRefExternal>, the <XRefExternal reference-type="act">Prohibition of the Export of Horses by Air for Slaughter Act</XRefExternal>, the <XRefExternal reference-type="act">Safe Food for Canadians Act</XRefExternal> and the <XRefExternal reference-type="act">Seeds Act</XRefExternal>.</Text></Paragraph></SectionPiece></AmendedText></Section><Heading level="1"><TitleText>Coming into Force</TitleText></Heading><Section type="amending"><MarginalNote>18 months</MarginalNote><Label>10</Label><Text>This Act comes into force 18 months after the day on which it receives royal assent.</Text></Section></Body></Bill>
