SUMMARYThis enactment amends the Canada Shipping Act, 2001 in order for a foreign national who holds a diploma issued by a prescribed Canadian maritime institution and for whom a permanent residence application is being processed to be eligible for a certificate of competency.

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:2001, c. 26Canada Shipping Act, 2001

1The definition qualified person in section 2 of the Canada Shipping Act, 2001 is amended by striking out “or” at the end of paragraph (a) and by adding the following after that paragraph:(a.1)a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who is referred to in subsection 88(1); or

2Subsection 88(1) of the Act is replaced by the following:

Holder of a certificate of competency88(1)Only the following persons may hold a certificate of competency that is issued under this Part: (a)a Canadian citizen; (b)a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act;(c)a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who holds a diploma issued by a prescribed Canadian maritime institution and for whom a permanent residence application under that Act is being processed.

3Section 100 of the Act is amended by adding the following after paragraph (c):(c.1)designating Canadian maritime institutions for the purpose of subsection 88(1);
