seizure without a warrant, as the case may be, fix a date for the hearing of the application and direct that notice of the hearing be given to such persons or in such manner as the justice may include-in-TableOfProvisions="no"><Section change="ins"><MarginalNote>Application — telecommunication producing writing</MarginalNote><Label>184.3</Label><Subsection><Label>(1)</Label><Text>A person who is permitted to make one of the following applications may submit their application by a means of telecommunication that produces a writing:</Text><Paragraph><Label>(a)</Label><Text>an application for an authorization under subsection 184.2(2), 185(1), 186(5.2) or 188(1);</Text></Paragraph><Paragraph><Label>(b)</Label><Text>an application for an extension under subsection 185(2), 196(2) or 196.1(2);</Text></Paragraph><Paragraph><Label>(c)</Label><Text>an application to renew an authorization under subsection 186(6).</Text></Paragraph></Subsection><Subsection><MarginalNote>Sealing</MarginalNote><Label>(2)</Label><Text>A judge who receives an application submitted by a means of telecommunication that produces a writing shall, immediately on the determination of the <Keep svc="1">application,</Keep> cause it to be placed and sealed in the packet referred to in subsection 187(1).</Text></Subsection><Subsection><MarginalNote>Application — telecommunication not producing writing</MarginalNote><Label>(3)</Label><Text>Despite anything in section 184.2 or 188, a person who is permitted to make an application for an authorization under subsection 184.2(2) or 188(1) may submit their application by a means of telecommunication that does not produce a writing if it would be impracticable in the circumstances to submit the application by a means of telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Statement of circumstances</MarginalNote><Label>(4)</Label><Text>An application submitted by a means of telecommunication that does not produce a writing shall include a statement of the circumstances that make it impracticable to submit the application by a means of telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Oath</MarginalNote><Label>(5)</Label><Text>Any oath required in connection with an application submitted by a means of telecommunication that does not produce a writing may be administered by a means of telecommunication.</Text></Subsection><Subsection><MarginalNote>Recording and sealing</MarginalNote><Label>(6)</Label><Text>A judge who receives an application submitted by a means of telecommunication that does not produce a writing shall record the application verbatim, in writing or otherwise, and shall, immediately on the determination of the application, cause the writing or recording to be placed and sealed in the packet referred to in subsection 187(1), and a recording sealed in a packet shall be treated as if it were a document for the purposes of section 187.</Text></Subsection><Subsection><MarginalNote>Limitation</MarginalNote><Label>(7)</Label><Text>If an application is submitted by a means of telecommunication that does not produce a writing, the judge shall not give the authorization unless he or she is satisfied that the application discloses reasonable grounds for dispensing with its submission by a means of telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Giving authorization, etc.</MarginalNote><Label>(8)</Label><Text>A judge who gives the authorization, extension or renewal may do so by a means of telecommunication, in which case</Text><Paragraph><Label>(a)</Label><Text>the judge shall complete and sign the document in question, noting on its face the time and date;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>if the means of telecommunication produces a writing, the judge shall transmit a copy of the document to the applicant by that means;</Text></Paragraph><Paragraph><Label>(c)</Label><Text>if the means of telecommunication does not produce a writing, the applicant shall, as directed by the judge, transcribe the document, noting on its face the name of the judge as well as the time and date; and</Text></Paragraph><Paragraph><Label>(d)</Label><Text>the judge shall, immediately after the authorization, extension or renewal is given, cause the document to be placed and sealed in the packet referred to in subsection 187(1).</Text></Paragraph></Subsection></Section></AmendedText><ExplanatoryNote><Label><Emphasis style="italic">Clause 6</Emphasis>:</Label><ExplanatoryText>Existing text of section 184.3:</ExplanatoryText><ExistingText><Section><Label>184.3</Label><Subsection><Label>(1)</Label><Text>Notwithstanding section 184.2, an application for an authorization under subsection 184.2(2) may be made <Language xml:lang="la">ex parte</Language> to a provincial court judge, a judge of a superior court of criminal jurisdiction or a judge as defined in section 552, by telephone or other means of telecommunication, if it would be impracticable in the circumstances for the applicant to appear personally before a judge.</Text></Subsection><Subsection><Label>(2)</Label><Text>An application for an authorization made under this section shall be on oath and shall be accompanied by a statement that includes the matters referred to in paragraphs 184.2(2)(a) to (e) and that states the circumstances that make it impracticable for the applicant to appear personally before a judge.</Text></Subsection><Subsection><Label>(3)</Label><Text>The judge shall record, in writing or otherwise, the application for an authorization made under this section and, on determination of the application, shall cause the writing or recording to be placed in the packet referred to in subsection 187(1) and sealed in that packet, and a recording sealed in a packet shall be treated as if it were a document for the purposes of section 187.</Text></Subsection><Subsection><Label>(4)</Label><Text>For the purposes of subsection (2), an oath may be administered by telephone or other means of telecommunication.</Text></Subsection><Subsection><Label>(5)</Label><Text>An applicant who uses a means of telecommunication that produces a writing may, instead of swearing an oath for the purposes of subsection (2), make a statement in writing stating that all matters contained in the application are true to the knowledge or belief of the applicant and such a statement shall be deemed to be a statement made under oath.</Text></Subsection><Subsection><Label>(6)</Label><Text>Where the judge to whom an application is made under this section is satisfied that the circumstances referred to in paragraphs 184.2(3)(a) to (c) exist and that the circumstances referred to in subsection (2) make it impracticable for the applicant to appear personally before a judge, the judge may, on such terms and conditions, if any, as are considered advisable, give an authorization by telephone or other means of telecommunication for a period of up to thirty-six hours.</Text></Subsection><Subsection><Label>(7)</Label><Text>Where a judge gives an authorization by telephone or other means of telecommunication, other than a means of telecommunication that produces a writing,</Text><Paragraph><Label>(a)</Label><Text>the judge shall complete and sign the authorization in writing, noting on its face the time, date and place at which it is given;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the applicant shall, on the direction of the judge, complete a facsimile of the authorization in writing, noting on its face the name of the judge who gave it and the time, date and place at which it was given; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the judge shall, as soon as is practicable after the authorization has been given, cause the authorization to be placed in the packet referred to in subsection 187(1) and sealed in that packet.</Text></Paragraph></Subsection><Subsection><Label>(8)</Label><Text>Where a judge gives an authorization by a means of telecommunication that produces a writing, the judge shall</Text><Paragraph><Label>(a)</Label><Text>complete and sign the authorization in writing, noting on its face the time, date and place at which it is given;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>transmit the authorization by the means of telecommunication to the applicant, and the copy received by the applicant shall be deemed to be a facsimile referred to in paragraph (7)(b); and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>as soon as is practicable after the authorization has been given, cause the authorization to be placed in the packet referred to in subsection 187(1) and sealed in that packet.</Text></Paragraph></Subsection></Section></ExistingText></ExplanatoryNote></Section><Section type="amending"><Label>7</Label><Text>Subsection 185(4) of the Act is replaced by the following:</Text><AmendedText include-in-TableOfProvisions="no"><Subsection><MarginalNote>If extension not granted</MarginalNote><Label>(4)</Label><Text><Ins>If</Ins> the judge to whom an application for an authorization and an application referred to in subsection (2) are made refuses to fix a period in substitution for the period mentioned in subsection 196(1) or <Ins>if</Ins> the judge fixes a <Ins>shorter</Ins> period than the <Ins>one</Ins> set out in the application referred to in subsection (2), the person <Ins>submitting</Ins> the application for the authorization may withdraw <Ins>that</Ins> application and, <Ins>if it is withdrawn</Ins>, the judge shall not proceed to consider <Ins>it</Ins> or to give the authorization and shall <Ins>destroy, or</Ins> return to <Ins>that</Ins> person, both applications and all other material pertaining <Ins>to them</Ins>.</Text></Subsection></AmendedText><ExplanatoryNote><Label><Emphasis style="italic">Clause 7</Emphasis>:</Label><ExplanatoryText>Existing text of subsection 185(4):</ExplanatoryText><ExistingText><Subsection><Label>(4)</Label><Text>Where the judge to whom an application for an authorization and an application referred to in subsection (2) are made refuses to fix a period in substitution for the period mentioned in subsection 196(1) or where the judge fixes a period in substitution therefor that is less than the period set out in the application referred to in subsection (2), the person appearing before the judge on the application for the authorization may withdraw the application for the authorization and thereupon the judge shall not proceed to consider the application for the authorization or to give the authorization and shall return to the person appearing before him on the application for the authorization both applications include-in-TableOfProvisions="no"><Subsection><MarginalNote>Exception</MarginalNote><Label>(1.1)</Label><Text>An authorization given under this Part need not be placed in the packet except <Ins>if, under</Ins> subsection 184.3(8), the original authorization is in the hands of the judge, in which case that judge must place it in the packet and the <Ins>copy</Ins> remains with the offence referred to in paragraph 2(1)(c) of that Act;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the accused or offender was previously required to appear for the purposes of that Act and the measurements, processes or operations referred to in that Act were not completed; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the justice or judge is satisfied that the reasons for the measurements, processes or operations not having been completed were exceptional.</Text></Paragraph></Subsection><Subsection><MarginalNote>Limitation</MarginalNote><Label>(2)</Label><Text>Subsection (1) applies in respect of an offender only if proceedings are ongoing in relation to the matter for which they were previously required to appear for the purposes of the <XRefExternal reference-type="act">Identification of Criminals Act</XRefExternal> and for which the sentencing proceedings have not concluded.</Text></Subsection><Subsection><MarginalNote>Reasons</MarginalNote><Label>(3)</Label><Text>The application must state the reasons why the measurements, processes or operations were not completed.</Text></Subsection><Subsection><MarginalNote><Language xml:lang="la">Ex parte</Language> application</MarginalNote><Label>(4)</Label><Text>A justice or telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Statement of circumstances</MarginalNote><Label>(6)</Label><Text>An application submitted by a means of telecommunication that does not produce a writing shall include a statement of the circumstances that make it impracticable to submit the application by a means of telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Oath</MarginalNote><Label>(7)</Label><Text>Any oath required in connection with an application submitted by a means of telecommunication that does not produce a writing may be administered by a means of telecommunication.</Text></Subsection><Subsection><MarginalNote>Certification</MarginalNote><Label>(8)</Label><Text>A judicial officer who receives an application submitted by a means of telecommunication that does not produce a writing shall record the application verbatim, in writing or otherwise, and certify the record or a transcription of it as to time, date and contents.</Text></Subsection><Subsection><MarginalNote>Limitation on issuance</MarginalNote><Label>(9)</Label><Text>If an application is submitted by a means of telecommunication that does not produce a writing, the judicial officer shall not issue the warrant, order, extension or authorization unless he or she is satisfied that the application discloses reasonable grounds for dispensing with its submission by a means of telecommunication that produces a writing.</Text></Subsection><Subsection><MarginalNote>Warrant, etc.</MarginalNote><Label>(10)</Label><Text>A judicial officer who issues the warrant, order, extension or authorization may do so by a means of telecommunication, in which case</Text><Paragraph><Label>(a)</Label><Text>the judicial officer shall complete and sign the document in question, noting on its face the time and date;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>if the means of telecommunication produces a writing, the judicial officer shall transmit a copy of the document to the applicant by that means; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>if the means of telecommunication does not produce a writing, the applicant shall, as directed by the judicial officer<Ins>,</Ins> transcribe the document, noting on its face the name of the judicial officer as well as the time and date.</Text></Paragraph></Subsection><Subsection><MarginalNote>Definitions</MarginalNote><Label>(11)</Label><Text>The following definitions apply in this section.</Text><Definition><Text><DefinedTermEn>judicial officer</DefinedTermEn> means a judge or justice who is authorized, under the applicable provision of this Act, to issue a warrant, order, extension or authorization referred to in subsection (1). (<DefinedTermFr>fonctionnaire judiciaire</DefinedTermFr>)</Text></Definition><Definition><Text><DefinedTermEn>public officer</DefinedTermEn> means a public officer who is appointed or designated to administer or enforce a federal or provincial law and whose duties include the enforcement of this Act or any other Act of Parliament. (<DefinedTermFr>fonctionnaire public</DefinedTermFr>)</Text></Definition></Subsection></Section></AmendedText><ExplanatoryNote><Label><Emphasis style="italic">Clause 22</Emphasis>:</Label><ExplanatoryText>Existing text of the heading and section 487.1:</ExplanatoryText><ExistingText><Heading level="2"><TitleText>Other Provisions Respecting Search Warrants, Preservation Orders and Production Orders</TitleText></Heading><Section><Label>487.1</Label><Subsection><Label>(1)</Label><Text>If a peace officer believes that an indictable offence has been committed and that it would be impracticable to appear personally before a justice to make an application for a warrant in accordance with section 487, the peace officer may submit an information on oath by telephone or other means of telecommunication to a justice designated for the purpose by the chief judge of the provincial court having jurisdiction in the matter.</Text></Subsection><Subsection><Label>(2)</Label><Text>An information submitted by telephone or other means of telecommunication, other than a means of telecommunication that produces a writing, shall be on oath and shall be recorded verbatim by the justice, who shall, as soon as practicable, cause to be filed, with the clerk of the court for the territorial division in which the warrant is intended for execution, the record or a transcription of it, certified by the justice as to time, date and contents.</Text></Subsection><Subsection><Label>(2.1)</Label><Text>The justice who receives an information submitted by a means of telecommunication that produces a writing shall, as soon as practicable, cause to be filed, with the clerk of the court for the territorial division in which the warrant is intended for execution, the information certified by the justice as to time and date of receipt.</Text></Subsection><Subsection><Label>(3)</Label><Text>For the purposes of subsection (2), an oath may be administered by telephone or other means of telecommunication.</Text></Subsection><Subsection><Label>(3.1)</Label><Text>A peace officer who uses a means of telecommunication referred to in subsection (2.1) may, instead of swearing an oath, make a statement in writing stating that all matters contained in the information are true to his or her knowledge and belief and such a statement is deemed to be a statement made under oath.</Text></Subsection><Subsection><Label>(4)</Label><Text>An information submitted by telephone or other means of telecommunication shall include</Text><Paragraph><Label>(a)</Label><Text>a statement of the circumstances that make it impracticable for the peace officer to appear personally before a justice;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>a statement of the indictable offence alleged, the place or premises to be searched and the items alleged to be liable to seizure;</Text></Paragraph><Paragraph><Label>(c)</Label><Text>a statement of the peace officer’s grounds for believing that items liable to seizure in respect of the offence alleged will be found in the place or premises to be searched; and</Text></Paragraph><Paragraph><Label>(d)</Label><Text>a statement as to any prior application for a warrant under this section or any other search warrant, in respect of the same matter, of which the peace officer has knowledge.</Text></Paragraph></Subsection><Subsection><Label>(5)</Label><Text>A justice referred to in subsection (1) may issue a warrant to a peace officer conferring the same authority respecting search and seizure as may be conferred by a warrant issued under subsection 487(1) if the justice is satisfied that an information submitted by telephone or other means of telecommunication</Text><Paragraph><Label>(a)</Label><Text>is in respect of an indictable offence and conforms to the requirements of subsection (4);</Text></Paragraph><Paragraph><Label>(b)</Label><Text>discloses reasonable grounds for dispensing with an information presented personally and in writing; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>discloses reasonable grounds in accordance with paragraph 487(1)(a), (b) or (c), as the case may be, for the issuance of a warrant in respect of an indictable offence.</Text></Paragraph><ContinuedSectionSubsection><Text>The justice may require that the warrant be executed within the period that he or she may order.</Text></ContinuedSectionSubsection></Subsection><Subsection><Label>(6)</Label><Text>Where a justice issues a warrant by telephone or other means of telecommunication, other than a means of telecommunication that produces a writing,</Text><Paragraph><Label>(a)</Label><Text>the justice shall complete and sign the warrant in Form 5.1, noting on its face the time, date and place of issuance;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the peace officer, on the direction of the justice, shall complete, in duplicate, a facsimile of the warrant in Form 5.1, noting on its face the name of the issuing justice and the time, date and place of issuance; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the justice shall, as soon as practicable after the warrant has been issued, cause the warrant to be filed with the clerk of the court for the territorial division in which the warrant is intended for execution.</Text></Paragraph></Subsection><Subsection><Label>(6.1)</Label><Text>Where a justice issues a warrant by a means of telecommunication that produces a writing,</Text><Paragraph><Label>(a)</Label><Text>the justice shall complete and sign the warrant in Form 5.1, noting on its face the time, date and place of issuance;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the justice shall transmit the warrant by the means of telecommunication to the peace officer who submitted the information and the copy of the warrant received by the peace officer is deemed to be a facsimile within the meaning of paragraph (6)(b);</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the peace officer shall procure another facsimile of the warrant; and</Text></Paragraph><Paragraph><Label>(d)</Label><Text>the justice shall, as soon as practicable after the warrant has been issued, cause the warrant to be filed with the clerk of the court for the territorial division in which the warrant is intended for execution.</Text></Paragraph></Subsection><Subsection><Label>(7)</Label><Text>A peace officer who executes a warrant issued by telephone or other means of telecommunication shall, before or as soon as practicable after entering the place or premises to be searched, give a facsimile of the warrant to any person who is present and ostensibly in control of the place or premises.</Text></Subsection><Subsection><Label>(8)</Label><Text>A peace officer who, in any unoccupied place or premises, executes a warrant issued by telephone or other means of telecommunication shall, on entering or as soon as practicable after entering the place or premises, cause a facsimile of the warrant to be suitably affixed in a prominent place within the place or premises.</Text></Subsection><Subsection><Label>(9)</Label><Text>A peace officer to whom a warrant is issued by telephone or other means of telecommunication shall file a written report with the clerk of the court for the territorial division in which the warrant was intended for execution as soon as practicable but within a period not exceeding seven days after the warrant has been executed, which report shall include</Text><Paragraph><Label>(a)</Label><Text>a statement of the time and date the warrant was executed or, if the warrant was not executed, a statement of the reasons why it was not executed;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>a statement of the things, if any, that were seized pursuant to the warrant and the location where they are being held; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>a statement of the things, if any, that were seized in addition to the things mentioned in the warrant and the location where they are being held, together with a statement of the peace officer’s grounds for believing that those additional things had been obtained by, or used in, the commission of an offence.</Text></Paragraph></Subsection><Subsection><Label>(10)</Label><Text>The clerk of the court shall, as soon as practicable, cause the report, together with the information and the warrant to which it pertains, to be brought before a justice to be dealt with, in respect of the things seized referred to in the report, in the same manner as if the things were seized pursuant to a warrant issued, on an information presented personally by a peace officer, by that justice or another justice for the same territorial division.</Text></Subsection><Subsection><Label>(11)</Label><Text>In any proceeding in which it is material for a court to be satisfied that a search or seizure was authorized by a warrant issued by telephone or other means of telecommunication, the absence of the information or warrant, signed by the justice and carrying on its face a notation of the time, date and place of issuance, is, in the absence of evidence to the contrary, proof that the search or seizure was not authorized by a warrant issued by telephone or other means of telecommunication.</Text></Subsection><Subsection><Label>(12)</Label><Text>A duplicate or a facsimile of an information or a warrant has the same probative force as the original for the purposes of has <Ins>been</Ins> seized and is <Ins>being</Ins> detained, to be dealt with in accordance with subsection 490(1), <Ins>if</Ins> the peace officer is not satisfied as described in subparagraphs or a preliminary inquiry, trial or other proceeding,</Text></Subparagraph><ContinuedParagraph><Text>return the thing seized, on being issued a receipt therefor, to the person lawfully entitled to its possession and report to the justice who issued the warrant or some other justice for the same territorial division or, if no warrant was issued, a justice having jurisdiction in respect of the matter, that he has done so; or</Text></ContinuedParagraph></Paragraph><Paragraph><Label>(b)</Label><Text>where the peace officer is not satisfied as described in subparagraphs (a)(i) and (ii),</Text><Subparagraph><Label>(i)</Label><Text>bring the thing seized before the justice referred to in paragraph (a), or</Text></Subparagraph><Subparagraph><Label>(ii)</Label><Text>report to the justice that he has seized the thing and is detaining it or causing it to be detained</Text></Subparagraph><ContinuedParagraph><Text>to be dealt with by the justice in accordance with subsection 490(1).</Text></ContinuedParagraph></Paragraph></Subsection><Subsection><Label>(2)</Label><Text>Subject to this or any other Act of Parliament, where a person, other than a peace officer, has seized anything under a warrant issued under this Act or under section 487.11 or 489 or otherwise in the execution of duties under this or any other Act of Parliament, that person shall, as soon as is practicable,</Text><Paragraph><Label>(a)</Label><Text>bring the thing seized before the justice who issued the warrant or some other justice for the same territorial division or, if no warrant was issued, before a justice having jurisdiction in respect of the matter, or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>report to the justice referred to in paragraph (a) that he has seized the
