SUMMARYThis enactment amends the Canada Shipping Act, 2001 to prohibit vessels from loading, at a port or marine installation in Canada, any thermal coal that is to be transported outside Canada.

1The Canada Shipping Act, 2001 is amended by adding the following after section 189:Vessels Loading Thermal Coal

Definitions189.1(1)The following definitions apply in this section.marine installation means an installation that is used or is capable of being used in the loading or unloading of thermal coal to or from vessels and that is on, or is connected to, land. (installation maritime)thermal coal means coal that is used to generate electricity. (charbon thermique)Prohibition — loading of coal(2)It is prohibited for a vessel to load into its hold, at a port or marine installation in Canada, any thermal coal that is to be transported outside Canada.

2Subsection 191(1) of the Act is amended by striking out “and” at the end of paragraph (c) and by adding the following after that paragraph:(c.1)subsection 189.1(2) (loading of thermal coal); and
