B-3; 1992, c. 27, s. 2</HistoricalNote></MarginalNote><TitleText>Bankruptcy and Insolvency Act</TitleText></Heading><Section type="amending"><Label>1</Label><Text>Paragraph  67(1)(b.3) of the <XRefExternal reference-type="act">Bankruptcy and Insolvency Act</XRefExternal> is replaced by the following:</Text><AmendedText><SectionPiece><Paragraph><Label>(b.3)</Label><Text>without restricting the generality of paragraph (b), property in a <DefinitionRef>registered retirement savings plan</DefinitionRef>, a <DefinitionRef>registered retirement income fund</DefinitionRef> or a <Ins><DefinitionRef><Keep>registered</Keep> education savings plan</DefinitionRef></Ins>, as those expressions are defined in the <XRefExternal reference-type="act">Income Tax Act</XRefExternal>, or in any prescribed plan, other than property contributed to any such plan or fund in the 12 months before the date of bankruptcy,</Text></Paragraph></SectionPiece></AmendedText></Section><Heading level="1"><TitleText>Coordinating Amendment</TitleText></Heading><Section type="amending"><MarginalNote><HistoricalNote>Bill C-97</HistoricalNote></MarginalNote><Label>2</Label><Text>If Bill C-97, introduced in the 1st session of the 42nd Parliament and entitled the <XRefExternal reference-type="act">Budget Implementation Act, 2019, No. 1</XRefExternal>, receives royal assent, then, on the first day on which both section 134 of that Act and section 1 of this Act are in force, paragraph 67(1)(b.3) of the <XRefExternal reference-type="act">Bankruptcy and Insolvency Act</XRefExternal> is replaced by the following:</Text><AmendedText><SectionPiece><Paragraph><Label>(b.3)</Label><Text>without restricting the generality of paragraph (b), property in a <DefinitionRef>registered retirement savings
