SUMMARYThis enactment amends the Canadian Environmental Protection Act, 1999 to prohibit the manufacture, use, sale, offer for sale or import of certain toxic substances that cause significant danger to the environment or to human life or health.

1999, c. 33Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1The Canadian Environmental Protection Act, 1999 is amended by adding the following after section 94:Prohibited Substances

Toxic substances94.1No person shall manufacture, use, sell, offer for sale or import a toxic substance listed in Schedule 2.1 or a product containing it.

Order94.2(1)The Ministers may, by order, add to Schedule 2.1 a substance specified on the List of Toxic Substances in Schedule 1, if they believe that doing so is required to deal with a significant danger to the environment or to human life or health, or delete any substance from Schedule 2.1.Advice by Committee(2)Before a substance is added to or deleted from Schedule 2.1, the Minister shall give the Committee an opportunity to advise the Ministers.

2Paragraph 272(1)(c) of the Act is replaced by the following:(c)contravenes a prohibition imposed under subsection 82(1) or (2), paragraph 84(1)(b), section 94.1, subsection 107(1) or (2), paragraph 109(1)(b) or subsection 186(1) or 225(4);

3The Act is amended by adding, after Schedule 2, Schedule 2.1 set out in the Schedule to this Act.

Coming into force4This Act comes into force one year after the day on which it receives royal assent.
