S-18<br /></MarginalNote><Para TopMargin="10" Bold="Yes" Hyphenate="OFF" TextAlign="Center">STATE IMMUNITY ACT</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>2.</B> Section 2 of the <I>State Immunity Act</I> is amended by adding the following in alphabetical order: </Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>“crime against humanity”<br />« <I>crime contre l’humanité</I> »<br /></MarginalNote><Para TopMargin="5" LeftMargin="0"><change>“crime against humanity” has the same meaning as in subsection 6(3) of the <I>Crimes Against Humanity and War Crimes Act</I>.</change></Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“genocide”<br />« <I>génocide</I> »<br /></MarginalNote><Para TopMargin="5" LeftMargin="0"><change>“genocide” has the same meaning as in subsection 6(3) of the <I>Crimes Against Humanity and War Crimes Act</I>.</change></Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“torture”<br />« <I>torture</I> »<br /></MarginalNote><Para TopMargin="5" LeftMargin="0"><change>“torture” has the same meaning as in subsection 269.1(2) of the <I>Criminal Code</I>.</change></Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“war crime”<br />« <I>crime de guerre</I> »<br /></MarginalNote><Para TopMargin="5" LeftMargin="0"><change>“war crime” has the same meaning as in subsection 6(3) of the <I>Crimes Against Humanity and War Crimes Act</I>.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>3.</B> The Act is amended by adding the following after section 8:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Genocide, crimes against humanity, war crimes, torture<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>8.1</B> (1) Subject to subsection (2), a foreign state is not immune from the jurisdiction of a court in any proceedings that relate to genocide, a crime against humanity, a war crime or torture.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Immunity maintained<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) Subsection (1) shall apply only after all domestic remedies have been invoked and exhausted in the matter, in conformity with the generally recognized principles of international law.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Subsection (2) does not apply<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) Subsection (2) does not apply when the application of the remedies is unreasonably prolonged or is unlikely to bring effective relief to the person who is the victim of genocide, a crime against humanity, a war crime or torture.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Temporal application<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) This section shall apply to all proceedings pending and initiated after its coming into force that relate to genocide, a crime against humanity, a war crime or torture that occurred on or after January 1, 1970.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>No expansion of jurisdiction<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(5) For greater certainty, this section provides a limited exception to the foreign state immunity otherwise provided for in this Act, but does not otherwise expand the jurisdiction of Canadian courts.</change></Para></Block><Block Align="Yes"><Para Style="BPT_ImprintE"><br /><br />Published under authority of the Speaker of the House of Commons</Para></Block><Block Align="Yes" LineCnt="N"><Para NoLineBreak="Yes" NoHtml="Yes" Leading="0" Size="0" TopMargin="0" BottomMargin="0"></Para></Block></Bill_Part></Bill>
