investment is of a category prescribed by the regulations.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Funds outside Canada — <keep>investments</keep><br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(6) Despite paragraph (3)(<I>a</I>), investments may be made in a person outside Canada if, in the opinion of the Board or any committee or officer designated by the Board,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) the person is an investment fund or other investment vehicle of which at least one half of the investment managers reside in Canada; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) that fund or vehicle has an investment strategy that reflects an ongoing commitment to invest in Canada.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Limitation<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(7) Paragraph (3)(<I>b</I>) does not apply</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) to a person that is a trust, a corporation as defined in subsection 2(1) of the <I>Canada Not-for-profit Corporations Act</I> or a corporation incorporated under a provincial statute equivalent to that Act; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) in the case where a loan, investment or guarantee is made or given through an arrangement referred to in paragraph FirstLineIndent="2">(<change>8</change>) The <change>services referred to in subsection (1)</change> are to fill out or complete services available from commercial financial institutions.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Acquiring and dealing with property<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(<change>9</change>) In any circumstances in which the Bank may <change>provide</change> a <change>service</change> to a person under this section, the Bank may</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) purchase or otherwise acquire real or personal property or immovables or movables including accounts receivable; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) subject to any right of redemption that may exist, hold, lease to the person or subsequently sell, dispose of or otherwise deal with the property <change>or immovables or movables</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definitions<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(10) The following definitions apply in this section.</change></Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“Canadian”<br />« <I>Canadien</I> »<br /></MarginalNote><Para TopMargin="5" LeftMargin="0"><change>“Canadian” has the same meaning as in paragraph (<I>a</I>), (<I>b</I>) or (<I>d</I>) of the definition “Canadian” in section 3 of the <I>Investment Canada Act</I>.</change></Para></Block><Block LineCnt="Y" corporation that entitles the owner to rights similar to those enjoyed by the owner of a voting share; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) with respect to a partnership, trust or joint venture, means an ownership interest in the assets of the partnership, trust or joint venture that entitles the owner to receive a share of the profits and to share in the assets on dissolution.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>218.</B> Section 17 of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Agreements<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>17.</B> <change>(1)</change> The Bank may provide, or enter into agreements for the provision of, <change>any of the following services</change>:</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) consulting;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) management training and <change>mentoring</change>;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) regulations.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Complementary to service providers<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) The services are to fill out or complete services available from private sector service providers.</change></Para></Block><Block LineCnt="Y" Despite subsection (1), if the election period for the first general election after the coming into force of section 1 would overlap with the election period for a general election to be held under subsection 56.1(2) or section 56.2 of the <I>Canada Elections Act</I>, the period during which the members referred to in subsection (1) continue in office as members of the Legislative Assembly may be extended until five years from the date fixed for the return of the writs at the last general election under the former Act, but the Commissioner may dissolve the Legislative Assembly before then.</change></Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><Para TopMargin="10" Bold="Yes" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Division 14</Para></Block><Block or body the power, exercisable in circumstances and subject to conditions similar to those applicable to the exercise of that power under the law of the province in which the undertaking is situated,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(i) to make orders requiring any person or body to cease any work, comply with the regulations or take any measure to remedy the consequences of any contravention of the regulations, or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) to do any work that the person or body considers necessary and to recover the costs of that work;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>d</I>) fix, or prescribe the manner of calculating, any charge to be paid in respect of the undertaking;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>e</I>) fix, or prescribe the manner of calculating, the rate of interest to be charged on amounts owing under the regulations;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>f</I>) establish offences punishable on summary conviction for contraventions of the regulations, if similar acts or omissions constitute an offence under the laws in force in the province in which the undertaking is situated, and set, for such offences, fines or terms of imprisonment, or both, that are not more than the fines or terms of imprisonment applicable under those laws;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>g</I>) establish administrative monetary penalties for contraventions of the regulations, if similar acts or omissions are punishable by administrative monetary penalties under the laws in force in the province in which the undertaking is situated, and set the amount of each of those penalties at an amount that is not more than the amount applicable under those laws;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>h</I>) set limits on the liability of, and establish defences and immunities for, any person or body exercising a power or performing a duty or function under the regulations;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>i</I>) confer on any person, for the purpose of verifying compliance with the regulations, the power to enter a place, to inspect the place and to seize and detain any thing found in that place, in circumstances and subject to conditions similar to those applicable to the exercise of that power under the law of the province in which the undertaking is situated;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>j</I>) require that security be given or a trust or fund be established to secure the performance of any obligation imposed under the regulations;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>k</I>) prescribe rules respecting the confidentiality or disclosure of any information obtained under the regulations;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>l</I>) provide for the retention or the disposal, including the destruction, of documents, regardless of medium, that are created or submitted under the regulations;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>m</I>) prescribe rules of procedure for hearings to be held in relation to the undertaking, including rules for the issuance of subpoenas to require the appearance of persons and the production of documents and rules requiring that evidence be given under oath, or confer on any person or body the power to prescribe those rules; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>n</I>) provide for the arbitration of disputes arising under the regulations.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Application to Crown<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) A regulation made under subsection (1) may be made binding on Her Majesty in right of Canada or a case may be,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) a Canadian law enforcement agency;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) a coroner or medical examiner, or a person or organization with similar duties or functions, who is acting in the course of their duties under an Act of Parliament or of a provincial legislature; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) a laboratory.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>233.</B> Section 3 of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Purpose<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>3.</B> The purpose of this Act is to establish a national DNA data bank to help</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>)</change> law enforcement agencies identify persons alleged to have committed designated offences, including those committed before the coming into force of this Act; <change>and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) law enforcement agencies — as well as coroners, medical purposes set out in paragraphs (<I>a</I>) and (<I>b</I>), a voluntary donors index.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Subsection 5(5) of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Victims index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4.1) The victims index shall contain DNA profiles derived from bodily substances of a victim of a designated offence that</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) are voluntarily submitted by the victim for the purpose of having their DNA profile added to the index; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) if the victim is unidentified, deceased or unable to consent to submitting their bodily substances or their whereabouts are unknown, are obtained, as the case may be, from</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(i) their personal effects,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) any place associated with the commission of the designated offence, and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(iii) if the victim is deceased, their remains.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Missing persons index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4.2) The missing persons index shall contain DNA profiles derived from bodily substances of a missing person, including bodily substances obtained from their personal effects.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Relatives of missing persons index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4.3) The relatives of missing persons index shall contain DNA profiles derived from bodily substances of a person that are voluntarily submitted by them for the purpose of having their DNA profile added to the index, where their profile may assist in confirming the identity of a person whose DNA profile is contained in the missing persons index or human remains index.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Human remains index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4.4) The human remains index shall contain DNA profiles derived from human remains.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Voluntary donors index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4.5) The voluntary donors index shall contain DNA profiles derived from the bodily substances of a person, other than a victim of a designated offence, that are voluntarily submitted by them for the purpose of having their DNA profile added to the index, where their profile may be relevant to an investigation of a designated offence or of a missing person or human remains.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Other information<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(5) In addition to the DNA profiles referred to in <change>subsections</change> (3) <change>to (4.5)</change>, the DNA data bank shall contain, in relation to each of the profiles, information from which can be established</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) in the case of a profile <change>referred to</change> in <change>subsection (3) or any of subsections (4.1) to (4.4)</change>, the case number of the investigation associated with the bodily substance from which the profile was derived;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) in the case of a profile <change>referred to</change> in <change>any of subsections (4) to (4.5)</change>, the identity of the person from whose bodily substance the profile was derived, <change>if that identity is known</change>; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) in the case of a profile referred to in subsection (4.3), the stated biological or other relationship of the person from whose bodily substance the profile was derived with the person whose identity profile and related information shall be added to the victims index only if the Commissioner has reasonable grounds to suspect that the comparison of the profile conducted under subsection 5.5(1) will and relatives<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) A DNA profile and related information shall be added to the missing persons index or the relatives of missing persons index only if the Commissioner</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) has reasonable grounds to suspect that the comparison of the profile conducted under section 5.5 will assist in the investigation of a missing person or human remains; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) is satisfied that other investigative procedures have been tried and have failed or are unlikely to succeed, or that the urgency of the situation requires the comparison of the profile to others.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Written consent<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>5.4</B> A DNA profile and related information shall be added to the relatives of missing persons index or the voluntary donors index, or to the victims index in the circumstances described in paragraph 5(4.1)(<I>a</I>), only if the Commissioner has received the written consent to that addition, provided in accordance with any regulations, of the person who voluntarily provided the bodily substances from which the profile was derived.</change></Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Comparison of Profiles and Communication and Use of Information--><Para TopMargin="10" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center"><change>Comparison of Profiles and Communication and Use of Information</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Comparison of DNA profiles<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>5.5</B> (1) The Commissioner shall compare each DNA profile that is added to the crime scene index, the convicted offenders index, the victims index, the missing person index, the voluntary donors index or the human remains index with the DNA profiles that are already contained in those indices.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Relatives of missing persons index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) The Commissioner shall compare each DNA profile that is added to the relatives of missing persons index with the DNA profiles that are already contained in the missing persons index and the human remains index.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Communication — match<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>6.</B> (1) If a comparison conducted under subsection 5.5(1) produces a match between DNA profiles, and none of the profiles that match is contained in the missing persons index or the human remains index, the Commissioner may communicate any information in relation to the profiles, to any laboratory or Canadian law enforcement agency that the Commissioner considers appropriate, for the purpose of</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) if at least one of the profiles is contained in the victims index, the investigation of a designated offence with respect to which that profile was obtained; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) in any other case, the investigation of any designated offence.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Missing persons and human remains indices<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) If a comparison conducted under subsection 5.5(1) produces a match between DNA profiles, and at least one of the profiles that match is contained in the missing persons index or the human remains index, the Commissioner may communicate any information in relation to the profiles, to any investigating authority that the Commissioner considers appropriate, for the purpose of the investigation of a missing person or human remains.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Communication <keep>— similar</keep> profile<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>6.1</B> (1) If a comparison conducted under subsection 5.5(1) indicates that, in the Commissioner’s opinion, two or more DNA profiles are similar, the Commissioner may communicate the similar DNA profiles, to any investigating authority that the Commissioner considers appropriate, for the purpose of determining whether the possibility of a match between the profiles can be excluded.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Deemed match<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) If the investigating authority advises the Commissioner that the profiles are similar and that the possibility of a match between the DNA profiles has not been excluded, the Commissioner may communicate any information in relation to the profiles in accordance with subsection 6(1) or (2), as the case may be, as if there were a match between them.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Relatives of missing persons index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) If a comparison conducted under subsection 5.5(2) indicates that a DNA profile that is already contained in the missing persons index or human remains index could be the profile of a biological relative of someone whose DNA profile is added to the relatives of missing persons index, the Commissioner may communicate any information in relation to both DNA profiles, to any investigating authority that the Commissioner considers appropriate, for the purpose of the investigation of a missing person or human remains.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Communication — no match<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>6.2</B> If a comparison conducted under section 5.5 produces neither a match between DNA profiles nor a result referred to in subsection 6.1(1) or (3), the Commissioner may communicate that fact to any investigating authority that the Commissioner considers appropriate.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Subsequent communication <keep>— paragraph</keep> 6(1)(<I>a</I>)<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>6.3</B> (1) Information that is communicated under paragraph 6(1)(<I>a</I>) may be communicated subsequently to a person to whom it is necessary to communicate the information for the purpose of the investigation or prosecution of a designated offence with respect to which the DNA profile referred to in that paragraph was obtained.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Subsequent communication <keep>— different</keep> purpose<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) Information that is communicated under paragraph 6(1)(<I>a</I>) to a law enforcement agency may be communicated subsequently by a member of the agency to a person to whom it is necessary to communicate the information for the purpose of the investigation or prosecution of any designated offence, if the member has reasonable grounds to suspect that the information will assist in the investigation or prosecution.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Further communication <keep>— different</keep> purpose<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) Information that is communicated to a person under subsection (2) may be communicated subsequently to another person to whom it is necessary to communicate the information for the purpose of the investigation or prosecution referred to in that subsection.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Subsequent communication <keep>— paragraph</keep> 6(1)(<I>b</I>)<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) Information that is communicated under paragraph 6(1)(<I>b</I>) may be communicated subsequently to a person to whom it is necessary to communicate the information for the purpose of the investigation or prosecution of any designated offence.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Subsequent communication <keep>— information for the purpose of the investigation or prosecution of a designated offence, if the member has reasonable grounds to suspect that the information will assist in the investigation or prosecution.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Further communication <keep>— different</keep> purpose<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(7) Information that is communicated to a person under subsection (6) may be communicated subsequently to another person to whom it is necessary to communicate the information for the purpose of the investigation or prosecution referred to in that subsection.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Communication <keep>— foreign</keep> law enforcement agencies<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B><change>6.4</change></B> (1) On receipt of a DNA profile from the government of a foreign state, an international organization established by the governments of states or an institution of such a government or international organization, the Commissioner may compare the profile with those <change>already contained</change> in the <change>crime scene index, the convicted offenders index, the missing persons index and the human remains index</change> to determine whether <change>there is a match between profiles</change> and may then communicate <change>any of the following</change> to the government, organization or institution, <change>as the case may be</change>:</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) if there is no match, that fact;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) if there is a match, any information in relation to a matching DNA profile that is already contained in any of those indices;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) if there is, in the Commissioner’s opinion, a similar DNA profile already contained in an index, the similar DNA profile;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>d</I>) if, after receiving the similar DNA profile referred to in paragraph (<I>c</I>), the government, organization or institution advises the Commissioner that the possibility of a match between the similar profile with the DNA profile it provided has not been excluded, any information in relation to the similar DNA profile.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Crime scene index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2)</change> The Commissioner may, on the request of a law enforcement agency in the course of the investigation of a designated offence, communicate a DNA profile contained in the crime scene index to the government of a foreign state, an international organization established by the governments of states or an institution of any such government or international organization.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Missing persons or human remains index<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) The Commissioner may, on the request of an investigating authority in the course of the investigation of a missing person or human remains, communicate a DNA profile contained in the missing persons index or the human remains index to the government of a foreign state, an international organization established by the governments of states or an institution of any such government or international organization.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Agreement or arrangement<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4)</change> Subsections <change>(1) to (3)</change> apply only if the Government of Canada or one of its institutions has entered into an agreement or arrangement, in accordance with <change>any regulations</change>, with that government, international organization or institution, authorizing the communication solely for the purposes of, <change>as the case may be</change>, the investigation or prosecution of a criminal offence <change>or the investigation of a missing person or human remains</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Authorized users<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B><change>6.5</change></B> Information as to whether a person’s DNA profile is contained in the convicted offenders index may be communicated to an authorized user of the automated criminal conviction records retrieval system maintained by the Royal Canadian Mounted Police.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Unauthorized communication<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B><change>6.6</change></B> Subject to sections <change>6 to 6.5</change>, no person shall communicate any information that is contained in the DNA data bank or allow the information to be communicated.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>239.</B> FirstLineIndent="0"><change>(<I>a</I>) the investigating authority has not been advised by the person from whose bodily substances the profile was derived that they wish to have access to the prevent a DNA profile derived from the bodily substances of the same person, and any information in relation to that profile, from subsequently being added to any index in accordance with this apply to the Blue Water Bridge Authority after its continuance under the <I>Canada Business Corporations Act</I>.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>263.</B> Sections 253 to 260 of the Act are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" that results from an amalgamation referred to in subsection 252(2) or of Blue Water Bridge Authority has any right to claim or receive any compensation, damages, indemnity or other form of relief from Her Majesty in right of Canada or from any employee or agent of Her Majesty for ceasing to hold that office or for the abolition of that office following any amalgamation referred to in subsection is of the opinion that</change> the federal credit union that results from the amalgamation will satisfy the requirements for incorporation as a federal credit union; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) the Minister will, immediately after issuing letters patent for the continuance, issue letters patent for the amalgamation under subsection 229(1).</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>273.</B> Section 37 of the Act is amended by adding the following after subsection (2):</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Notice of continuance and amalgamation<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) In the case of a continuance that results from an application made under subsection 33(3) or (4), the Superintendent may publish, in the form of a single notice, the notice referred to subsection (2), the notice required under subsection 229(3) in respect of the amalgamation and any notice required under subsection (2) in respect of other applicants for the amalgamation.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>274.</B> Section 223 of the Act is amended by adding the following after subsection (1.1):</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Federal credit union and local cooperative credit society<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(1.2) On the joint application of one or more federal credit unions and one or more local cooperative credit societies that have applied under subsection 33(3) to be continued as federal credit unions, the Minister may issue letters patent amalgamating and continuing the applicants as one federal credit union.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Local cooperative credit societies<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(1.3) On the joint application of two or more local cooperative credit societies that have applied under subsection 33(4) to be continued as federal credit unions, the Minister may issue letters patent amalgamating and continuing the applicants as one (1):</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Exception<br /></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(1.1) In the case of an application made under subsection 223(1.2) or (1.3), the Minister shall not issue letters patent of amalgamation unless the Minister has issued, under subsection 35.1(2), letters patent continuing as a federal credit union each applicant that was a local cooperative credit society.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>277.</B> omitted to be done or for anything purported to have been done or omitted to be done, in the exercise or performance of their powers, duties and functions.</Para></Block><Block LineCnt="Y"
