Align="Yes" KeepWith="Next"><!--Heading:Definitions--><Para TopMargin="5" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Definitions</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definitions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>17.</B> The following definitions apply in sections 18 to 20.</Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“former department”<br/>« <I>ancien ministère</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“former department” means the portion of the federal public administration known as Shared Services Canada.</Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“new department”<br/>« <I>nouveau ministère</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“new department” means Shared Services Canada as established by section 4.</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Former Department--><Para TopMargin="10" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Former Department</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>President<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>18.</B> (1) The person occupying the position of President of the former department on the day on which this section comes into force becomes President of the new department on that day and is deemed to have been appointed under subsection 10(1).</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Employees<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Nothing in this Act is to be construed as affecting the status of an employee who, immediately before the coming into force of this section, occupied a position in the former department, except that the employee is, on the coming into force of this section, to occupy that position in the new department.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definition of “employee”<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) In subsection (2), “employee” has the same meaning as in subsection 2(1) of the <I>Public Service Employment Act</I>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Transfer of appropriations<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>19.</B> (1) Any amount that is appropriated, for the fiscal year in which this section comes into force, by an appropriation Act based on the Estimates for that year for defraying the federal public administration’s charges and expenses for the former department that is unexpended on the day on which this section comes into force is deemed, on that day, to be an amount appropriated for defraying the federal public administration’s charges and expenses for the new department.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Transfer of powers, duties and functions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) If a power, duty or function is vested in or exercisable by the former department’s President or an employee of the former department under any Act, order, rule or regulation, or any contract, lease, licence or other document, that power, duty or function is vested in or is exercisable by the new department’s President or an employee of the new department.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>References<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>20.</B> (1) A reference to the former department in any of the following is deemed to be a reference to the new department:</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) Schedule I to the <I>Access to Information Act</I> under the heading “OTHER GOVERNMENT INSTITUTIONS”;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the schedule to the <I>Privacy Act</I>;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) any order of the Governor in Council made under subsection 3.2(2) of the <I>Access to Information Act</I>;</Para></Block><Block LineCnt="Y" Align="No"><Para Employment Act</I>; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>f</I>) Schedules I.1, IV and VI to the <I>Financial Administration Act</I>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Deputy head<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) The designation of a person as deputy head of the former department in any of the following is deemed to be a designation of the President of the new department as deputy head of that department:</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) any order of the Governor in Council made under paragraph 29(<I>e</I>) of the <I>Canadian Security Intelligence Service Act</I>; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) any order of the Governor in Council made under the definition “deputy head” Bold="Yes"><B>713.</B> (1) The definitions “assisted reproduction procedure”, “consent”, “controlled activity”, “health reporting information” and “licence” in section 3 of the <I>Assisted Human Reproduction Act</I> are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) The definition “Agency” in section 3 of the Act is repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>714.</B> The Act is amended by adding the following after section 4:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Non-application<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>4.1</B> The <I>Human Pathogens and Toxins Act</I> does not apply in respect of sperm, ova and <I>in vitro</I> embryos to be used for the purpose of assisted human reproduction.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>715.</B> The Act is amended by adding the following after section 4.1:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Non-application<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>4.2</B> The <I>Food and Drugs Act</I> does not apply in respect of sperm and ova to be used for the purpose of assisted human reproduction.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>716.</B> The Act is amended by adding the following after section 9:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Purpose<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>10.</B> (1) The purpose of this section is to reduce the risks to human health and safety arising from the use of sperm or ova for the purpose of assisted human reproduction, including the risk of the transmission of disease.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Distribution, etc. of gametes<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) Subject to subsection (3), no person shall distribute, make use of or import any of the following for the purpose of assisted human reproduction:</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) sperm that has been obtained from a donor and that is meant for the use of a female person other than a spouse, common-law partner or sexual partner of the donor;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) an ovum that has been obtained from a donor and that is meant for the use of a female person other than the donor or the spouse, common-law partner or sexual partner of the donor; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) an ovum that has been obtained from a donor and that is meant for the donor’s use as a surrogate mother.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Exception<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) Subsection (2) does not apply if</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) tests have been conducted in respect of the sperm or ovum in accordance with the regulations, and the sperm or ovum has been obtained, prepared, preserved, quarantined, identified, labelled and stored and its quality assessed in accordance with the regulations; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) the donor of the sperm or ovum has been screened and tested, and the donor’s suitability has been assessed, in accordance with the regulations.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Testing, etc. in respect of gametes<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) No person shall, except in accordance with the regulations, engage in any activity described in paragraph (3)(<I>a</I>) or (<I>b</I>) in respect of any of the following with the intention of distributing or making use of it for the purpose of assisted human reproduction:</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) sperm described in paragraph (2)(<I>a</I>);</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) an ovum described in paragraph (2)(<I>b</I>); or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) an ovum described in paragraph (2)(<I>c</I>).</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definition of “common-law partner”<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(5) In this section, “common-law partner”, in relation to an individual, means a person who is cohabiting with the individual in a conjugal relationship at the relevant time, having so cohabited for a period of at least one year.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>717.</B> Section 10 of the Act and the heading before it are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>718.</B> Section 11 of the Act is repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>719.</B> (1) The portion of subsection 12(1) of the Act before paragraph (<I>a</I>) is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Reimbursement of expenditures<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>12.</B> (1) No person shall, except in accord-<keep>ance with</keep> the regulations,</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Paragraph 12(3)(<I>b</I>) of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the reimbursement is made in accordance with the regulations.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>2004, c. 11, s. 53<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>720.</B> Sections 13 to 19 of the Act are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>721.</B> Subsection 20(2) of the Act is repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>2010, c. 12, s. 1656<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>722.</B> The heading before section 21 and sections 21 to 39 of the Act are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>723.</B> The heading before section 40 of the Act is replaced by the following:</Para></Block><Block LineCnt="N" measures<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>44.</B> (1) <change>If the Minister has reasonable grounds to believe that this Act has been, or is likely to be, contravened,</change> the <change>Minister</change> may take, or order any person to take, all reasonable measures that the <change>Minister</change> considers necessary <change>to</change> mitigate <change>the effects of the contravention or</change> to prevent <change>the contravention</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Subsections 44(2) to (4) of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Personal liability<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4) No person <change>who takes measures</change> under this section, <change>or who takes measures specified in an order made under this section</change>, is personally liable either civilly or criminally <change>in respect of any act or omission in the course of taking those measures</change> unless it is established that the person acted in bad faith.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Exception<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(5)</change> <change>Subsection (4) does not apply to a person who has committed a contravention of this Act.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote><I>Statutory Instruments Act</I><br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(6) For greater certainty, orders made under this section are not statutory instruments within the meaning of the <I>Statutory Instruments Act</I>.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>726.</B> The heading before section 45 of the Act is repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>727.</B> Section 46 of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Designation of inspectors<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>46.</B> (1) The <change>Minister</change> may designate <change>persons or classes of persons</change> employed by the government of Canada or of a province as <change>inspectors</change> for the <change>purposes</change> of the <change>administration and</change> enforcement of this Act.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Certificates to be produced<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) An inspector shall be given a certificate in a form established by the <change>Minister</change> attesting to the inspector’s designation and, on entering any place or conveyance under subsection 47(1), the inspector shall, if so required, produce the certificate to the person in charge of that place or conveyance.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>728.</B> (1) Subsection 47(1) of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Entry by inspectors<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>47.</B> (1) Subject to section <change>related to verifying compliance or preventing non-compliance with any of sections 8, 10 and 12</change>, and</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>730.</B> Subsection 51(1) of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Application for restoration<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>51.</B> (1) A person from whom material or information is seized may, within 60 days after the date of the seizure, apply to a provincial court judge within whose jurisdiction the seizure was made for an order of restoration, if the person sends <change>to</change> the <change>Minister</change> notice <change>of their intention to do so</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>731.</B> Subsection 52(3) of the Act is <change>an inspector</change> may dispose of material or information forfeited to Her Majesty in any manner that the <change>designated officer, as defined in the regulations</change>, directs.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>732.</B> Sections 54 and 55 of the Act are replaced by the <change>Minister</change> may designate any person as an analyst for the purpose of the <change>administration and</change> enforcement of this Act.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>733.</B> Sections 58 and 59 of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Agreements for enforcement<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>58.</B> The <change>Minister</change> may enter into agreements with or who are storing any of them for that purpose,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) the communication of information to the persons referred to in subparagraph (i), to the donors of the sperm and ova and to the persons who have undergone assisted human reproduction procedures in which the sperm or ova were used,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(iii) measures to be taken to determine the nature, cause and extent of the risks to human health and safety, and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(iv) measures to be taken in respect of the sperm and ova to reduce those risks;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>d.3</I>) respecting the reporting to the Minister of information with respect to an activity described in section 10;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>e</I>) respecting the <change>reimbursement of</change> expend-<keep>itures for</keep> the purposes of subsection 12(1), <change>including providing for the expenditures that may be reimbursed</change>;</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Paragraphs 65(1)(<I>f</I>) to (<I>m</I>) of the Act are repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(3) Paragraphs 65(1)(<I>n</I>) to (<I>q</I>) of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>n</I>) respecting the creation and maintenance of records by <change>any person who</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(i)</change> <change>engages in an activity for which written consent is required under section 8,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) engages in an activity described in section 10, LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>r</I>) authorizing the Minister, in the manner set out in the regulations, to require any person described in paragraph (<I>n</I>) to provide to the Minister any records that the person is required by the regulations to create or maintain, and any additional information related to the activity described in subparagraph (<I>n</I>)(i), (ii) or (iii), and requiring that person to provide to the Minister those records and that information within the time and in the manner set out in the regulations;</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(5) Paragraph 65(1)(<I>y</I>) of the English version of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>y</I>) for the purposes of subsection 51(1), prescribing the from Her Majesty in right of Canada or from any employee or agent of Her Majesty for ceasing to hold that office or for the abolition of that office by operation of this Division.</Para></Block><Block advised that they will be laid off in accordance with subsection 64(1) of the <I>Public Service Employment Act</I> is, for the purpose of any workforce adjustment meas-<keep>ure taken</keep> with respect to them, transferred to the Department of Health on the day on which section 722 comes into force.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Rights and obligations
