Subsection 2(1) of the <I>Immigration and Refugee Protection Act</I> is amended by adding the following in alphabetical order:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="0"><change>(<I>c</I>) in any other case, until five years after the day on which the foreign national becomes a designated foreign national.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Refusal to consider application<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(1.3) The officer may refuse to consider an application for permanent residence made under subsection (1) if</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) the designated foreign national fails, without reasonable excuse, to comply with any condition imposed on them under subsection 58(4) or section 58.1 or any requirement imposed on them under section 98.1; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) less than 12 months have passed since the end of the applicable period referred to in subsection (1.1) or (1.2).</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>6.</B> The Act is amended by adding the following after section 11:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 6</I>: New.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Biometric information<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>11.1</B> A prescribed foreign national who makes an application for a temporary resident visa, study permit or work permit must follow the prescribed procedures for the collection of prescribed biometric information.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>7.</B> Subsections 13(1) to (3) of the Act are replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 7</I>: Existing text of subsections 13(1) to (3):</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2"><B>13.</B> (1) A Canadian citizen or permanent resident may, subject to the regulations, sponsor a foreign national who is a member of the family class.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(2) A group of Canadian citizens or permanent residents, a corporation incorporated under a law of Canada or of a province, and an unincorporated organization or association under federal or provincial law, or any combination of them may, subject to the regulations, sponsor a Convention refugee or a person in similar circumstances.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(3) An undertaking relating to sponsorship is binding on the person who gives it.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Sponsorship of foreign nationals<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>13.</B> (1) A Canadian citizen or permanent resident, or a group of Canadian citizens or permanent residents, a corporation incorporated under a law of Canada or of a province or an unincorporated organization or association under federal or provincial law — or any combination of them — may sponsor a foreign national, subject to the regulations.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>8.</B> The Act is amended by adding the following after section 13:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 8</I>: New.</Para></ExplNote></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Undertakings--><Para TopMargin="10" Italic="Yes" Hyphenate="OFF" TextAlign="Center"><change>Undertakings</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Undertaking binding<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>13.1</B> An undertaking given under this Act in respect of a foreign national — including a sponsorship undertaking — is binding on the person who gives it.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Undertaking required<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>13.2</B> (1) If required to do so by the regulations, a foreign national who makes an application for a visa or for permanent or temporary resident status must obtain the undertaking specified in the regulations.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Minister’s instructions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) An officer must apply the regulations made under paragraph 14(2)(<I>e.1</I>) in accordance with any instructions that the Minister may give.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>9.</B> (1) Paragraph 14(2)(<I>e</I>) of the Act is replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 9</I>: (1) Relevant portion of subsection 14(2):</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(2) The regulations may prescribe, and govern any matter relating to, classes of permanent residents or foreign nationals, including the classes referred to in section 12, and may include provisions respecting</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">...  </Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>e</I>) sponsorships, undertakings, and penalties for failure to comply with undertakings;</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>e</I>) sponsorships;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>e.1</I>)</change> undertakings, and penalties for failure to comply with undertakings;</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Section 14 of the Act is amended by adding the following after subsection (2):</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2">(2) New.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Biometric information<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) The regulations may provide for any matter relating to the application of section 11.1, including</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) the circumstances in which a foreign national is exempt from the requirement to follow the procedures prescribed under that section;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) the circumstances in which a foreign national is not required to provide certain biometric information; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) the processing of the collected biometric information, including creating biometric templates or converting the information into digital biometric formats.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>10.</B> The Act is amended by adding the following after section 20:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 10</I>: New.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Designation — human smuggling or other irregular arrival<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>20.1</B> (1) The Minister may, by order, having regard to the public interest, designate as an irregular arrival the arrival in Canada of a group of persons if he or she</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) is of the opinion that examinations of the persons in the group, particularly for the purpose of establishing identity or determining inadmissibility — and any investigations concerning persons in the group — cannot be conducted in a timely manner; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) has reasonable grounds to suspect that, in relation to the arrival in Canada of the group, there has been, or will be, a contravention of subsection 117(1) for profit, or for the benefit of, at the direction of or in association with a criminal organization or terrorist group.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Effect of designation<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) When a designation is made under subsection (1), a foreign national — other than a foreign national referred to in section 19 — who is part of the group whose arrival is the subject of the designation becomes a designated foreign national unless, on arrival, they hold the visa or other document required under the regulations and, on examination, the officer is satisfied that they are not inadmissible.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote><I>Statutory Instruments Act</I><br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) An order made under subsection (1) is not a statutory instrument for the purposes of the <I>Statutory Instruments Act</I>. However, it must be published in the <I>Canada Gazette</I>.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Application for permanent residence — restriction<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>20.2</B> (1) A designated foreign national may not apply to become a permanent resident</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) if they have made a claim for refugee protection but have not made an application for protection, until five years after the day on which a final determination in respect of the claim is made;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) if they have made an application for protection, until five years after the day on which a final determination in respect of the application is made; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) in any other case, until five years after the day on which they become a designated foreign national.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Suspension of application for permanent residence<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) The processing of an application for permanent residence of a foreign national who, after the application is made, becomes a designated foreign national is suspended</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) if the foreign national has made a claim for refugee protection but has not made an application for protection, until five years after the day on which a final determination in respect of the claim is made;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) if the foreign national has made an application for protection, until five years after the day on which a final determination in respect of the application is made; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) in any other case, until five years after the day on which the foreign national becomes a designated foreign national.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Refusal to consider application<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) The officer may refuse to consider an application for permanent residence if</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) the designated foreign national fails, without reasonable excuse, to Leading="9" LeftMargin="0" FirstLineIndent="2">(2) Except in the case of a person described in subsection 112(3) or a person who is a member of a prescribed class of persons, a person whose application for protection has been finally determined by the Board to be a Convention refugee or to be a person in need of protection, or a person whose application for protection has been allowed by the Minister, becomes, subject to any federal-provincial agreement referred to in subsection 9(1), a permanent resident if the officer is satisfied that they have made their application in accordance with the regulations and that they are not inadmissible on any ground referred to in section 34 or 35, subsection 36(1) or section 37 or 38.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Protected person<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Except in the case of a person who is a member of a prescribed class of persons, a person <change>who</change> has <change>made</change> a <change>claim</change> for <change>refugee</change> protection or an application for protection <change>and who</change> has been finally determined by the Board to be a Convention refugee or to be a person in need of protection, becomes, subject to any federal-provincial agreement referred to in subsection 9(1), a permanent resident if the officer is satisfied that they have made their application in accordance with the regulations and that they are not inadmissible on any ground referred to in section 34 or 35, subsection 36(1) or section 37 or 38.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Section 21 of the Act is amended by adding the following after subsection (2):</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2">(2) New.</Para></ExplNote></Block><Block LineCnt="Y" if the applicable fees in respect of that request have been paid.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(1.2) The Minister may not examine the request if the foreign national has already made such a request and the request is pending.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(1.3) In examining the request of a foreign national in Canada, the Minister may not consider the factors that are taken into account in the determination of whether a person is a Convention refugee under section 96 or a person in need of protection under subsection 97(1) but must consider elements related to the hardships that affect the foreign national.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Humanitarian and compassionate considerations — request of foreign national<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>25.</B> (1) <change>Subject to subsection (1.2),</change> the Minister must, on request of a foreign national in Canada who <change>applies for permanent resident status</change> and who is inadmissible or does not meet the requirements of this Act, and may, on request of a foreign national outside Canada <change>who applies for a permanent resident visa</change>, examine the circumstances concerning the reasonable efforts to establish their identity.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) the Minister is taking necessary steps to inquire into a reasonable suspicion that they are inadmissible on grounds of security, violating human or international rights, <change>serious criminality, criminality or organized criminality</change>;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) the Minister is of the opinion that the identity of the foreign national <change>— other than a designated foreign national who was 16 years of age or older on the day of the arrival that is the subject of the designation in question —</change> has not been, but may be, established and they have not reasonably cooperated with the Minister by providing relevant information for the purpose of establishing their identity or the Minister is making reasonable efforts to establish their identity; <change>or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>e</I>) the Minister is of the opinion that the identity of the foreign national who is a designated foreign national and who was 16 years of age or older on the day of the arrival that is the subject of the designation in question has not been established.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Section 58 of the Act is amended by adding the following after subsection (3):</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2">(2) New.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Conditions — designated foreign national<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) If the Immigration Division orders the release prescribed.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>27.</B> The Act is amended by adding the following after section 58:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 27</I>: New.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Release — Minister<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>58.1</B> The Minister may, on request of a designated foreign national who was 16 years of age or older on the day of the arrival that is the subject of the designation in question, order their release from detention if, in the Minister’s opinion, exceptional circumstances exist that warrant the release. The Minister may impose any conditions, including the payment of a deposit or the posting of a guarantee for compliance with the conditions, that he or she considers necessary.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>28.</B> Paragraph 61(<I>a</I>) of the Act is replaced by the be a person referred to in section F of Article 1 of the Refugee Convention.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) The portion of subsection 117(2) of the French version of the Act before paragraph (<I>a</I>) is replaced by the following:</Para><ExplNote><Para The date fixed for the interview must not be earlier than 15 days after the day on which the claim is referred, unless the claimant consents to an earlier date.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(4.1) The official of the Board who conducts the interview must, in accordance with the regulations and any directions of the Chairperson of the Board, fix the date on which the claimant is to attend a hearing before the Refugee Protection Division.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Documents and information to be provided<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) A person who makes a claim for refugee protection inside Canada at a port of entry and whose claim is referred to the Refugee Protection Division must provide the Division, within the time limits provided for in the regulations, with the documents and information — including in respect of the basis for the claim — required by the rules of the Board, in accord-<keep>ance with</keep> those rules.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Date of hearing<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4.1) The <change>referring officer</change> must, in accord-<keep>ance with</keep> the regulations, <change>the rules of the Board</change> and any directions of the Chairperson of the Board, fix the date on which the claimant is to attend a hearing before the Refugee Protection Division.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>57.</B> Section 11.1 of the Act is amended by replacing the section 107.1 that it enacts with the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 57</I>: Text of enacted section 107.1:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2"><B>107.1</B> If the Refugee Protection Division rejects a claim for refugee protection, it may state in its reasons for the decision that the claim is manifestly unfounded if it is of the opinion that the claim is clearly fraudulent.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Manifestly unfounded<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>107.1</B> If the Refugee Protection Division rejects a claim for refugee protection, it <change>must</change> state in its reasons for the decision that the claim is manifestly unfounded if it is of the opinion that the claim is clearly fraudulent.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>58.</B> Section 12 of the Act is amended by replacing the section 109.1 that it enacts with the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 58</I>: Text of enacted section 109.1:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2"><B>109.1</B> (1) The Minister may, by order, for the purposes of section 111.1, designate a country or part of a country or a class of nationals of a country.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(1.1) The Minister may make a designation only if</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) the number of claims for refugee protection made in Canada by nationals of the country in question is equal to or greater than the number set out in the regulations; and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the rate of acceptance by the Refugee Protection Division of claims made by nationals of the country in question is equal to or lower than the rate set out in the regulations.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(1.2) In making a designation, the Minister must take the following criteria into account:</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) the human rights record of the country in question as it relates to</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="4" FirstLineIndent="0">(i) the factors set out in sections 96 and 97, and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="4" FirstLineIndent="0">(ii) the international human rights instruments specified in the regulations and any other international instrument that the Minister considers relevant;</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the availability in the country in question of mechanisms for seeking protection and redress;</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) the number of claims for refugee protection made in Canada by nationals of the country in question;</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) the rate of acceptance by the Refugee Protection Division of claims made by nationals of the country in question and the rate of appeals allowed by the Refugee Appeal Division in respect of appeals made by nationals of the country in question; and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>e</I>) any other criteria set out in the regulations.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(2) An order referred to in subsection (1) is not a statutory instrument for the purposes of the <I>Statutory Instruments Act</I>. However, it must be published in the <I>Canada Gazette</I>.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Designation of countries of origin<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>109.1</B> (1) The Minister may, by order, designate a country, for the purposes of <change>subsection 110(2) and</change> section 111.1.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Limitation<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) The Minister may only make a designation</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) in the case where the number of claims for refugee protection made in Canada by nationals of the country in question in respect of which the Refugee Protection Division has made a final determination is equal to or greater than the number provided for by order of the Minister,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(i) if the rate, expressed as a percentage, that is obtained by dividing the total number of claims made by nationals of the country in question that, in a final determination by the Division during the period provided for in the order, are rejected or determined to be withdrawn or abandoned by the total number of claims made by nationals of the country in question in respect of which the Division has, during the same period, made a final determination is equal to or greater than the percentage provided for in the order, or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) if the rate, expressed as a percentage, that is obtained by dividing the total number of claims made by nationals of the country in question that, in a final determination by the Division, during the period provided for in the order, are determined to be withdrawn or abandoned by the total number of claims made by nationals of the country in question in respect of which the Division has, during the same period, made a final determination is equal to or greater than the percentage provided for in the order; or</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) in the case where the number of claims for refugee protection made in Canada by nationals of the country in question in respect of which the Refugee Protection Division has made a final determination is less than the number provided for by order of the Minister, if the Minister is of the opinion that in the country in question</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(i) there is an independent judicial system,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(ii) basic democratic rights and freedoms are recognized and mechanisms for redress are available if those rights or freedoms are infringed, and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="4" FirstLineIndent="0"><change>(iii) civil society organizations exist.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Order of Minister<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) The Minister may, by order, provide for the number, period or percentages referred to in subsection (2).</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote><I>Statutory Instruments Act</I><br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(<change>4</change>) An order <change>made under</change> subsection (1) <change>or (3)</change> is not a statutory instrument for the purposes of the <I>Statutory Instruments Act</I>. However, it must be published in the <I>Canada Gazette</I>.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>59.</B> Section 14.1 of the Act is amended by replacing the section 111.1 that it enacts with the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 59</I>: Text of enacted section 111.1:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2"><B>111.1</B> (1) The regulations may provide for any matter relating to the application of this Division, and may include provisions</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) relating to the criteria referred to in subsection 109.1(1.2) and the process to be followed with respect to a designation made under subsection 109.1(1);</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) establishing criteria for the purposes of paragraph 109.1(1.2)(<I>e</I>); and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) respecting the time limits</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="4" FirstLineIndent="0">(i) for the hearing referred to in subsection 100(4.1),</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="4" FirstLineIndent="0">(ii) for the filing and perfecting of an appeal under subsection 110(2.1), and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="4" FirstLineIndent="0">(iii) for the making of a decision by the Refugee Appeal Division, the extension of those time limits and the circumstances under which they do not apply.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(2) Regulations made under subparagraph (1)(<I>c</I>)(i) may provide for time limits for any of the following claimants that are different from the time limits for other claimants:</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) claimants who are nationals of a country that is, on the date of their interview referred to in subsection 100(4), a country designated under subsection 109.1(1);</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) claimants who are nationals of a country of which a part is, on the date of their interview referred to in subsection 100(4), a part designated under subsection 109.1(1); or</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) claimants who belong to a class of nationals of a country that is, on the date of their interview referred to in subsection 100(4), a class designated under subsection 109.1(1).</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(3) Regulations made under subparagraph (1)(<I>c</I>)(ii) may provide for time limits for the filing and perfecting of appeals by any of the following claimants that are different from the time limits for other claimants:</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) claimants whose claims are found by the Refugee Protection Division to be manifestly unfounded under section 107.1;</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) claimants who are nationals of any country that is, on the day on which the decision being appealed is made, a country designated under subsection 109.1(1);</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) claimants who are nationals of a country of which a part is, on the day on which the decision being appealed is made, a part designated under that subsection and who lived in that designated part before they left the country; or</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) claimants who belong to a class of nationals of a country that is, on the day on which the decision being appealed is made, a class designated under that subsection.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2">(4) Regulations made under subparagraph (1)(<I>c</I>)(iii) may provide for time limits for making decisions in respect of appeals by claimants referred to in paragraphs (3)(<I>a</I>) to (<I>d</I>) that are different from the time limits for other claimants.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Regulations<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>111.1</B> (1) The regulations LeftMargin="2" FirstLineIndent="0"><change>(<I>d</I>)</change> <change>time limits</change> for the filing and perfecting of an appeal under subsection 110(2.1); and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>e</I>)</change> <change>time limits</change> for the making of a decision by the Refugee Appeal Division, the extension of those time limits and the circumstances <change>in</change> which they do not apply.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Clarification — regulations made under paragraph (1)(<I>b</I>)<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) <change>With respect to</change> claimants who are nationals of a country that is, on the day on which their <change>claim</change> is made, a country designated under subsection 109.1(1), regulations made under <change>paragraph</change> (1)<change>(<I>b</I>)</change> may provide for time limits that are different from the time limits for other claimants.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>60.</B> (1) Subsection 15(1) of the Act is amended by replacing the portion of subsection 112(1.2) before paragraph (<I>a</I>) that it enacts with the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" the date of <change>the hearing</change> referred to in subsection 100(<change>4.1</change>);</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" so.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>65.</B> Subsection 25(3) of the Act is amended by replacing the French of the Refugee Protection Division in respect of an application for protection, as well as written reasons for the decision, must be provided.</Para></ExplNote></Block><Block LineCnt="Y" LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>66.</B> Sections 33 and 34 of the Act are replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 66</I>: Text of sections 33 and 34:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>33.</B> (1) The <I>Immigration and Refugee Protection Act</I>, as amended by this Act, applies to every claim for refugee protection made before the day on which this section comes into force if, before that day, the claimant has not submitted a Personal Information Form, as defined in section 1 of the <I>Refugee Protection Division Rules</I>, as they read immediately before that day, and the time limit for submitting that Form has not expired.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) The day of the interview that the claimant referred to in subsection (1) must attend under subsection 100(4) of the <I>Immigration and Refugee Protection Act</I>, as enacted by subsection 11(2), is to be fixed by an official of the Immigration and Refugee Board.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>34.</B> (1) The <I>Immigration and Refugee Protection Act</I>, as amended by this Act, except subsections 100(4) and (4.1), applies to every claim for refugee protection made before the day on which this section comes into force if, before that day,</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0" Bold="Yes">(<I>a</I>) the claimant has submitted a Personal Information Form, as defined in section 1 of the <I>Refugee Protection Division Rules</I>, as they read immediately before that day; and</Para><Para Align="No" TopMargin="5" Size="8" Leading="9" LeftMargin="2" FirstLineIndent="0" Bold="Yes">(<I>b</I>) there has been no hearing before the Refugee Protection Division in respect of the claim or, if there has been a hearing, no substantive evidence has been heard.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) The claimant referred to in subsection (1) must attend an interview with an official of the Immigration and Refugee Board, if required to do so, on the date fixed by the official in accordance with the <I>Refugee Protection Division Rules</I> and must produce any supplementary documents and information that the official considers necessary.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Refugee protection claim referred<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>33.</B> (1) <change>Except its subsections 100(4) and (4.1),</change> the <I>Immigration and Refugee Protection Act</I>, as amended by this Act, applies to every claim for refugee protection <change>that is referred to the Refugee Protection Division</change> before the day on which this section comes into force if, before that day, <change>there has been no hearing before the Refugee Protection Division in respect of the claim or, if there has been a hearing, no substantive evidence has been heard</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Personal Information Form<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) <change>If</change> a Personal Information Form, as defined in section 1 of the <I>Refugee Protection Division Rules</I> as they read immediately before <change>the day on which this section comes into force</change>, has not <change>been</change> submitted <change>in respect of a claim that is referred to the Refugee Protection Division before</change> that day and the time limit for submitting that Form has not expired, the claimant <change>must submit that Form in accordance with those Rules, as they read on that day</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Hearing date<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><change>(3) If, before the day on which this section comes into force, no date has been fixed for the hearing before the Refugee Protection Division in respect of a claim that is referred to that Division before that day, an official of the Immigration and Refugee Board must fix the date on which the claimant is to attend the hearing.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Member who is assigned<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><change><B>34.</B> A member who is assigned to the Refugee Protection Division under paragraph 159(1)(<I>b</I>) of the <I>Immigration and Refugee Protection Act</I>, as it read immediately before the day on which subsection 19(1) of this Act comes into force, may, if authorized by the Chairperson, remain assigned to that Division. However, the member may hear and make decisions only in respect of claims for refugee protection referred to that Division before that day.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>67.</B> Subsection 35(2) of the Act is replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 67</I>: Text of subsection 35(2):</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) If the single member is unable to continue to hear the claim, the claim must be referred to a member of the Refugee Protection Division referred to in section 169.1 of the <I>Immigration and Refugee Protection Act</I>, as enacted by section 26, and that member must commence a new hearing in accordance with that Act, as amended by this Act.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Single member unable to continue<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) If the single member is unable to continue to hear the claim, the claim must be referred to <change>another</change> member of the Refugee Protection Division, and that member must commence a new hearing in accordance with the <I>Immigration and Refugee Protection Act</I>, as amended by this Act.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>68.</B> Sections 36 to 37.1 of the Act are replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 68</I>: Text of sections 36 to 37.1:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>36.</B> (1) A decision made by the Refugee Protection Division before the day on which this section comes into force is not subject to appeal to the Refugee Appeal Division.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) The person in respect of whom the decision was made is not required to wait for the expiry of the 12-month period referred to in paragraph 112(2)(<I>b.1</I>) of the <I>Immigration and Refugee Protection Act</I>, as enacted by subsection 15(3), before making an application under subsection 112(1) or (1.1) of that Act.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>37.</B> If a decision referred to in subsection 36(1) is set aside in a judicial review, the claim for refugee protection must be referred to a member of the Refugee Protection Division referred to in section 169.1 of the <I>Immigration and Refugee Protection Act</I>, as enacted by section 26.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>37.1</B> An application for protection that is made before the day on which subsection 15(1) comes into force is to be considered in accordance with the <I>Immigration and Refugee Protection Act</I>, as that Act read immediately before that day.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>No appeal<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>36.</B> (1) A decision made by the Refugee Protection Division <change>in respect of a claim for refugee protection that was referred to that Division</change> before the day on which this section comes into force is not subject to appeal to the Refugee Appeal Division.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>No 12-month waiting period<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) <change>A</change> person in respect of <change>whose claim the Refugee Protection Division has</change> made <change>a</change> decision <change>before the day on which this section comes into force</change> is not required to wait for the expiry of the 12-month period referred to in paragraph 112(2)(<I>b.1</I>) of the <I>Immigration and Refugee Protection Act</I>, as enacted by subsection 15(3), before making an application under subsection 112(1) or (1.1) of that Act, as enacted by subsection 15(1).</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Decision set aside in judicial review<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>37.</B> If a decision referred to in subsection 36(1) is set aside in a judicial review, the claim for refugee protection must be referred to a member of the Refugee Protection Division <change>who is appointed under</change> section 169.1 of the <I>Immigration and Refugee Protection Act</I>, as enacted by section 26, <change>and is to be considered in accordance with that Act, as amended by this Act. However, the member’s decision is not subject to appeal to the Refugee Appeal Division</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Application for protection<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>37.1</B> <change>Subject to regulations made under subsection 201.1 of</change> the <I>Immigration and Refugee Protection Act</I>, an application for protection that is made before the day on which subsection 15(1) comes into force is to be considered in accordance with that Act, as <change>amended by this Act</change>.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>69.</B> Section 42 of the Act is replaced by the following:</Para><ExplNote><Para Align="Yes" TopMargin="10" LeftMargin="0" FirstLineIndent="2"><I>Clause 69</I>: Text of section 42:</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>42.</B> (1) Subject to subsection (2), the provisions of this Act, except sections 3 to 6, 9, 13, 14, 28, 31, 32, 39 and 40, come into force two years after the day on which this Act receives royal assent or on any earlier day or days that may be fixed by order of the Governor in Council.</Para><Para Align="Yes" TopMargin="5" Size="8" Leading="9" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Subsections 15(1), (2) and (5) and sections 16, 16.1, 27.1 and 37.1 come into force 12 months after the day on which subsection 15(3) comes into force, or on any earlier day that may be fixed by order of the Governor in Council.</Para></ExplNote></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Order in council<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>42.</B> The provisions of this Act, except sections 3 to 6, 9, 13, 14, 28, 31, 32, 39 and 40, come into force on <change>a</change> day or days <change>to</change> be fixed by order of the Governor in Council.</Para></Block></Bill_Part></Bill>
