A-2<br/></MarginalNote><Para TopMargin="10" Bold="Yes" Hyphenate="OFF" TextAlign="Center">AERONAUTICS ACT</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>2004, c. 15, s. 6<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>2.</B> (1) Subsection 4.83(1) of the <I>Aeronautics Act</I> is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Foreign states requiring information<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>4.83</B> (1) Despite section 5 of the <I>Personal Information Protection and Electronic Documents Act</I>, to the extent that that section relates to obligations set out in Schedule 1 to that Act relating to the disclosure of information, and despite subsection 7(3) of that Act, an operator of an aircraft departing from Canada that is due to land in a foreign state or fly over <change>the United States</change> and land outside Canada or of a Canadian aircraft departing from any place outside Canada that is due to land in a foreign state or fly over <change>the United States</change> may, in accordance with the regulations, provide to a competent authority in that foreign state any information that is in the operator’s control relating to persons on board or expected to be on board the aircraft and that is required by the laws of the foreign state.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Notice<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(1.1) The operator of an aircraft that is due to fly over, but not land in, the United States must notify all persons who are on board or expected to be on board the aircraft that information relating to them may be provided to a competent authority in the United States in accordance with subsection (1).</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><change>(2) Section 4.83 of the Act is amended by adding the following after subsection (3):</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Review and report<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) Within two years after this subsection comes into force and every five years thereafter, the committee of the House of Commons responsible for transport matters shall:</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) commence a comprehensive review of the provisions and operation of this Act; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) within three months after the review is completed, submit a report to the House of Commons setting out its findings.</change></Para></Block><Block Align="Yes"><Para Style="BPT_ImprintE">Published under authority of the Speaker of the House of Commons<br/></Para></Block><Block Align="Yes" LineCnt="N"><Para NoLineBreak="Yes" NoHtml="Yes" Leading="0" Size="0" TopMargin="0" BottomMargin="0"></Para></Block></Bill_Part></Bill>
