" Bill-Origin="commons"><Bill_Part Part_Type="MainText" CountLines="Yes" RunningHead_E="Employment Insurance (qualification for and entitlement to benefits)"><Block Align="Yes"><Para Style="MainText_DocNo">402122</Para></Block><Block LineCnt="N" Align="Yes"><Para Style="Session_Reign">2nd Session, 40th Parliament,</Para></Block><Block LineCnt="N" Align="Yes"><Para Style="Session_Reign">57 Elizabeth II, 2009</Para></Block><Block LineCnt="N" Align="Yes"><Para Style="MainBillOrigin">house of commons of canada</Para></Block><Block LineCnt="N" Align="Yes"><Para Bold="Yes" Style="MAIN@BillNo_Title">BILL C-280</Para></Block><Block LineCnt="N" Align="Yes"><Para Style="MAIN@ti;04">An Act to amend the Employment Insurance Act (qualification for and entitlement to benefits)</Para></Block><Block LineCnt="Y" Align="Yes"><Para LeftMargin="0" FirstLineIndent="2" Hyphenate="ON" TextAlign="Justify">Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:EMPLOYMENT INSURANCE ACT--><MarginalNote>1996, c. 23<br/></MarginalNote><Para TopMargin="10" Hyphenate="OFF" TextAlign="Center"><B>EMPLOYMENT INSURANCE ACT</B></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>1.</B> Subsection 2(5) of the <I>Employment Insurance Act</I> is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Weeks of benefits paid<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(5) For the purposes of section 145, the Commission may, with the approval of the Governor in Council, make regulations for establishing how many weeks of benefits a claimant was paid, in order to take into account benefit reductions or deductions in the calculation or payment of those benefits.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>2.</B> (1) The definitions “major attachment claimant” and “minor attachment claimant” in subsection 6(1) of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>“major attachment claimant”<br/>« <I>prestataire de la première catégorie</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“major attachment claimant” means a claimant who qualifies to receive benefits and has <change>360</change> or more hours of insurable employment in their qualifying period;</Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“minor attachment claimant”<br/>« <I>prestataire de la deuxième catégorie</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“minor attachment claimant” means a claimant who qualifies to receive benefits and has fewer than <change>360</change> hours of insurable employment in their qualifying period;</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>3.</B> Subsections 7(1) to (5) of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Qualification requirement<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>7.</B> (1) An insured person qualifies to receive benefits if the person</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) has had an interruption of earnings from employment; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) has had during their qualifying period at least <change>360</change> hours of insurable employment.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>4.</B> Subsections 7.1(1) and (2) of the Act are replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Increase in required hours<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>7.1</B> (1) The number of hours that an insured person requires under section 7 to qualify for benefits is increased to</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>)</change> <change>525 hours</change> if the insured person accumulates one or more <change>minor</change> violations,</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>)</change> <change>700 hours if the insured person accumulates one or more serious violations,</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>)</change> <change>875 hours if the insured person accumulates one or more very serious violations, and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>d</I>)</change> <change>1050 hours if the insured person accumulates one or more subsequent violations</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="0">in the 260 weeks before making their initial claim for benefit.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>5.</B> (1) Subsection 14(1) of the Act is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Rate of weekly benefits<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>14.</B> (1) The rate of weekly benefits payable to a claimant is 55% <change>of the average</change>  of their weekly insurable earnings <change>for the 12 weeks in</change> <change>which the claimant received the highest earnings during the 12-month period preceding the week in which the interruption in earnings occurred.</change></Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Subsection 14(2) of the Act is repealed.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>6.</B> The portion of subsection 153.1(1) of the Act before paragraph (<I>a</I>) is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Regulations<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>153.1</B> (1)  Despite anything in this Act, the Commission shall, with the approval of the Governor in Council, make any regulations it considers necessary respecting the establishment and operation of a scheme to ensure that special benefits are provided to insured persons who have at least <change>360</change> hours of insurable employment in their qualifying period but who do not qualify to receive benefits under section 7, including regulations</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:COMING INTO FORCE--><Para TopMargin="10" Hyphenate="OFF" TextAlign="Center"><B>COMING INTO FORCE</B></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Coming into force<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>7.</B> This Act comes into force 30 days after the date on which it is assented to.</Para></Block><Block Align="Yes"><Para Style="BPT_ImprintE">Published under authority of the Speaker of the House of Commons<br/>Available from:<br/>Publishing and Depository Services<br/>Public Works and Government Services Canada<br/>Ottawa, Ontario K1A 0S5<br/>Telephone: 613-941-5995 or 1-800-635-7943<br/>Fax: 613-954-5779 or 1-800-565-7757<br/>publications@tpsgc-pwgsc.gc.ca<br/>http://publications.gc.ca</Para></Block><Block Align="Yes" LineCnt="N"><Para NoLineBreak="Yes" NoHtml="Yes" Leading="0" Size="0" TopMargin="0" BottomMargin="0"></Para></Block></Bill_Part></Bill>
