" Bill-Origin="commons"><Bill_Part Part_Type="MainText" CountLines="Yes" RunningHead_E="Accountability"><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Coordinating Amendment--><Para TopMargin="10" Bold="Yes" Italic="Yes" Hyphenate="OFF" TextAlign="Center">Coordinating Amendment</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>227.</B> On the later of the day on which section 81 of the <I>Parliament of Canada Act</I>, as enacted by section 28 of this Act, comes into force and the day on which section 24 of the <I>Public Servants Disclosure Protection Act</I> comes into force ― or, if those days are the same day, then on that day ― section 24 of the <I>Public Servants Disclosure Protection Act</I> is amended by adding the following after subsection (2):</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Jurisdiction of the Conflict of Interest and Ethics Commissioner<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2.1) The Commissioner must refuse to deal with a disclosure or to commence an investigation if he or she is of the opinion that the subject-matter of the disclosure or the investigation is within the jurisdiction of the Conflict of Interest and Ethics Commissioner under the <I>Conflict of Interest Act</I> and must refer the matter to the Conflict of Interest and Ethics Commissioner.</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Salaries Act--><MarginalNote>R.S., c. S-3<br/></MarginalNote><Para TopMargin="10" Bold="Yes" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Salaries Act</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>228.</B> The <I>Salaries Act</I> is amended by adding the following after section 1:</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:PUBLIC APPOINTMENTS COMMISSION--><Para TopMargin="10" Hyphenate="OFF" TextAlign="Center">PUBLIC APPOINTMENTS COMMISSION</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Functions of Commission<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>1.1</B> <change>(1)</change> The Governor in Council may establish a Public Appointments Commission, consisting of a chairperson and not more than four other members</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>a</I>) to oversee, monitor, review and report on the selection process for appointments and reappointments by the Governor in Council to agencies, boards, commissions and Crown corporations, and to ensure that every such process is widely made public and conducted in a fair, open and transparent manner and that the appointments are based on merit;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>b</I>) to evaluate and approve the selection processes proposed by ministers to fill vacancies and determine reappointments within their portfolios, monitor and review those processes, and ensure that they are implemented as approved, giving special attention to any instances in which ministers make appointments that are inconsistent with the recommendations of appointment panels;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c</I>) to develop and establish a code of practice for appointments by the Governor in Council and ministers that sets out the steps that are necessary for a fair, open and transparent appointment process, including requirements for appointments and criteria for appointments to be made fully public;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>d</I>) to audit appointment policies and practices in order to determine whether the code of practice is being observed;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>e</I>) to report publicly on compliance with the code of practice, in particular by providing an annual report to the Prime Minister to be transmitted to the Speaker of each House of Parliament for tabling and referral to the appropriate committee of that House for study;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>f</I>) to provide public education and training of public servants involved in appointment and reappointment processes regarding the code of practice; and</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>g</I>) to perform any other function specified by the Governor in Council.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Appointment<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) Before making a recommendation to the Governor in Council that a person be appointed to the Commission, the Prime Minister shall consult with the leader of every recognized party in the House of Commons. An announcement of an appointment shall be transmitted to the Speaker of the House of Commons for tabling in that House.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Term of office<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(3) Members of the Commission hold office during good behaviour for a term of five years and may be reappointed for a further term or terms, but are removable for cause by the Governor in Council.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Report to Parliament<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(4) In its report, the Commission shall identify any material failure to comply with its code of practice by any department, Minister or official.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Remuneration and expenses<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change><B>1.2</B> (1) Members of the Public Appointments Commission shall be paid the remuneration and expenses fixed by the Governor in Council.</change></Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Appointment of staff<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><change>(2) Any employees that are required by the Commission to enable it to carry out its functions shall be appointed in accordance with the <I>Public Service Employment Act</I>.</change></Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Coming into Force--><Para TopMargin="10" Bold="Yes" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Coming into Force</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Order in council<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>229.</B> <change>(1)</change> <change>Sections 3.01 and</change> 3.1 of the <I>Access to Information Act</I>, as enacted by section 144 of this Act, <change>and section 3.01 of the <I>Privacy Act</I>, as enacted by section 182 of this Act</change>, as well as <change>subsection 143(2),</change> sections 145 to 151, 156 <change>and</change> 159 to 162, <change>subsection 164(1),</change> sections <change>165</change> to <change>179, subsection 181(2) and sections</change> 183, 184 and 186 to 193 of this Act and any <change>provisions</change> enacted by those provisions come into force on a day or days to be fixed by order of the Governor in Council.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Canada Pension Plan Investment Board<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><change>(2) Despite subsection (1), the definition “government institution” in section 3 of the <I>Access to Information Act</I>, as enacted by subsection 143(2) of this Act, and the definition “government institution” in section 3 of the <I>Privacy Act</I>, as enacted by subsection 181(2) of this Act, do not apply in respect of the Canada Pension Plan Investment Board unless the lieutenant governor in council of each of at least two thirds of the included provinces, within the meaning of subsection 114(1) of the <I>Canada Pension Plan</I>, having in the aggregate not less than two thirds of the population of all of the included provinces, has signified the consent of that province to the application of those definitions to the Board.</change></Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><Para TopMargin="10" Bold="Yes" of Schedule VI, means its deputy minister; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) with respect to a department named in Part II or III of Schedule VI, means the person occupying the position set out opposite that name.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Accountability of accounting officers within framework of ministerial accountability<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>16.4</B> (1) Within the framework of the appropriate minister’s responsibilities and his or her accountability to Parliament, and subject to the appropriate minister’s management and direction of his or her department, the accounting officer of a department named in Part I of Schedule VI is accountable before the appropriate <change>committees</change> of <change>the Senate and the House of Commons</change> for</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) the measures taken to organize the resources of the department to deliver departmental programs in compliance with government policies and procedures;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the measures taken to maintain effective systems of internal control in the department;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) the signing of the accounts that are required to be kept for the preparation of the Public Accounts pursuant to section 64; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) the performance of other specific duties assigned to him or her by or under this or any other Act in relation to the administration of the department.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Accountability of accounting officers within framework of ministerial accountability<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Within the framework of the appropriate minister’s duties assigned to him or her by or under this or any other Act in relation to the administration of the department.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Appearance before committee<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) The obligation of an accounting officer under this section is to appear before the appropriate committee of <change>the Senate or the House of Commons</change> and answer questions put to him or her by members of the committee in respect of the carrying out of the responsibilities and the performance of the duties referred to in subsection (1) or (2), as the case may be.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Written guidance from Secretary<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>16.5</B> (1) Where the appropriate minister and the accounting officer for a department named in Part I or II of Schedule VI are unable to agree on the interpretation or application of a policy, directive or standard issued by the Treasury Board, the accounting officer shall seek guid­ance in writing on the matter from the Secretary of the Treasury Board.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Referral to Treasury Board<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Where guidance is provided under subsection (1) and the matter remains unresolved, the appropriate minister shall refer the matter to the Treasury Board for a decision.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Copy to Auditor General<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) A decision by the Treasury Board shall be in writing and a copy shall be provided to the Auditor General of Canada.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Cabinet confidence<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4) The copy of a decision provided to the Auditor General of Canada is a confidence of the Queen’s Privy Council for Canada for the purposes of any Act of Parliament.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>262.</B> The Act is amended by adding the following before the heading “PART IV” before section 43:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Five-year reviews<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>42.1</B> (1) Subject to and except as otherwise provided in any directives issued by the Treasury Board, every department shall conduct a review every five years of the relevance and effectiveness of each ongoing program for which it is responsible.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definition of “program”<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) In this section, “program” means a program of grants or contributions made to one or more recipients that are administered so as to achieve a common objective and for which spending authority is provided in an appropriation Act.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>263.</B> Section 80 of the Act is renumbered as subsection 80(1) and is amended by adding the following:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Fraud against Her Majesty<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Every officer or person acting in any office or employment connected with the collection, management or disbursement of public money who, by deceit, falsehood or other fraudulent means, defrauds Her Majesty of any money, securities, property or service is guilty of an indictable offence and liable on conviction,</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) if the amount of the money or the value of the securities, property or service does not exceed $5,000, to a fine not exceeding $5,000 and to imprisonment for a term not exceeding five years; or</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) if the amount of the money or the value of the securities, property or service exceeds $5,000, to a fine not exceeding that amount or that value and to imprisonment for a term not exceeding fourteen years.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>2005, c. 30, s. 51<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>264.</B> (1) Subsection 85(1) of the Act is replaced by the other than an officer-director, of a parent Crown corporation shall be appointed by the appropriate Minister, with the approval of the Governor in Council, to hold office during pleasure for a term not exceeding four years that will ensure, as far as possible, the expiration in any one year of the terms of office of not more than one half of the directors of the corporation.</Para></Block><Block and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) any report made in good faith by the Auditor General in the course of the performance or purported performance of audit powers, duties or functions under this <change>or any other</change> Act <change>of Parliament</change>, and any fair and accurate account of the report made in good faith in a newspaper or any other periodical publication or in a broadcast, is privileged.</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Department of Public Works and Government Services Act--><MarginalNote>1996, c. 16<br/></MarginalNote><Para TopMargin="10" Bold="Yes" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Department of Public Works and Government Services Act</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>309.</B> The <I>Department of Public Works and Government Services Act</I> is amended by adding the following after section 22:</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:PROCUREMENT AUDITOR--><Para TopMargin="10" Hyphenate="OFF" TextAlign="Center">PROCUREMENT AUDITOR</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Appointment<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>22.1</B> (1) The Governor in Council may appoint a Procurement Auditor for a term of not more than five years.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Remuneration and expenses<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) The Procurement Auditor shall be paid the remuneration and expenses that may be fixed by the Governor in Council.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>General duties and functions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) The Procurement Auditor shall, in accord­ance with the regulations,</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) review the practices of departments for acquiring materiel and services to assess their fairness, openness and transparency and make any appropriate recommendations to the relevant department for the improvement of those practices;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) review any complaint respecting the compliance with any regulations made under the <I>Financial Administration Act</I> of the award of a contract for the acquisition of materiel or services by a department to which the Agreement, as defined in section 2 of the <I>Agreement on Internal Trade Implementation Act</I>, would apply if the value of the contract were not less than the amount referred to in article 502 of that Agreement;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) review any complaint respecting the administration of a contract for the acquisition of materiel or services by a department; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) ensure that an alternative dispute resolution process is provided, on request of each party to such a contract.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Other duties and functions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4) The Procurement Auditor shall also perform any other duty or function respecting the practices of departments for acquiring materiel and services that may be assigned to the Procurement Auditor by order of the Governor in Council or the Minister.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Person who may complain<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>22.2</B> (1) A person may only file a complaint referred to in paragraph 22.1(3)(<I>b</I>) or (<I>c</I>) if that person is a Canadian supplier within the meaning of article 518 of the agreement referred to in paragraph 22.1(3)(<I>b</I>) and meets any requirements prescribed by the regulations.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Timing of complaint<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) The complaint may only be filed after the award of the contract to which the complaint relates.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Findings and recommendations<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) The Procurement Auditor shall, within the period after the complaint is filed that may be established by the regulations, provide the complainant, the relevant minister and the Minister with the Procurement Auditor’s fin­dings and any recommendations.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Limitation<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4) The Procurement Auditor may not recommend the cancellation of the contract to which the complaint relates.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Annual Report<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>22.3</B> (1) The Procurement Auditor shall, within four months after the end of each fiscal year, deliver a report respecting the activities of the Procurement Auditor in that year to the Minister.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Annual report to be laid<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) The Minister shall cause a copy of the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the Minister receives the report.</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>310.</B> The Act is amended by adding the following after section 23:</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Regulations<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2"><B>23.1</B> The Governor in Council may make regulations respecting</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) the performing of the duties and functions of the Procurement Auditor referred to in subsection 22.1(3), including the departments in respect of which those duties and functions shall not be performed;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) the filing of complaints referred to in paragraphs 22.1(3)(<I>b</I>) and (<I>c</I>), including any conditions that must be met before a complaint may be filed and the manner in which it must be filed; and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) the types of recommendations that the Procurement Auditor may make in response to the complaints and the time within which they must be made.</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Financial Administration Act--><MarginalNote>R.S., c. and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) respecting the provision of information or records to enable the Auditor General of Canada to inquire into the use of funds provided under funding agreements.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Powers of Auditor General<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(2) Regulations made under subsection (1) may not infringe on the powers of the Auditor General under section 7.1 of the <I>Auditor General Act</I>.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Regulations — public opinion research<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(3) The Governor in Council may, in respect of contracts for public opinion research, make regulations</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) prescribing the form and content of the term of the contract and of the written report referred to in subsection 40(2); and</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) requiring the report to be made available to the public in the manner, and subject to the conditions, specified in the regulations.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Definitions<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2">(4) The following definitions apply in this section.</Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“funding agreement”<br/>« <I>accord de financement</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“funding agreement”, in respect of a recipient, means an agreement in writing under which the recipient receives <change>a grant, contribution or other</change> funding from Her Majesty in right of Canada or a Crown corporation, either directly or through an agent or mandatary of Her Majesty, including by way of loan, but excludes contracts for the performance of work, the supply of goods or the rendering of services.</Para></Block><Block LineCnt="Y" Align="No"><MarginalNote>“recipient”<br/>« <I>bénéficiaire</I> »<br/></MarginalNote><Para TopMargin="5" LeftMargin="0">“recipient” means an individual, body corporate, partnership or unincorporated organization that has, in any five consecutive fiscal years, received a total of one million dollars or more under one or more funding agreements, but does not include</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) a Crown corporation;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>b</I>) a departmental corporation;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>c</I>) the government of a foreign state, a provincial government <change>or</change> a municipality;</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0"><change>(<I>c.1</I>) the council of a band as defined in subsection 2(1) of the<I> Indian Act</I>, any member of the council or any agency of the band or an aboriginal body that is party to a self-government agreement given effect by an Act of Parliament or any of their agencies;</change></Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>d</I>) a corporation that is controlled by a municipality or a government other than the Government of Canada; or</Para></Block><Block LineCnt="Y" Align="No"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>e</I>) an international organization.</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Coordinating Amendment--><Para TopMargin="10" Bold="Yes" Italic="Yes" Hyphenate="OFF" TextAlign="Center">Coordinating Amendment</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>316.</B> On the day on which section 66 of this Act comes into force, paragraph 42(1)(<I>a</I>) of the <I>Financial Administration Act</I> is replaced by the following:</Para></Block><Block LineCnt="Y" Align="Yes"><Para TopMargin="5" LeftMargin="2" FirstLineIndent="0">(<I>a</I>) prohibiting payment of a contingency fee by any party to the contract to a person to whom the <I>Lobbying Act</I> applies;</Para></Block><Block LineCnt="N" Align="Yes" KeepWith="Next"><!--Heading:Coming into Force--><Para TopMargin="10" Bold="Yes" SmallCaps="Yes" Hyphenate="OFF" TextAlign="Center">Coming into Force</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Order in council<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes"><B>317.</B> (1) Sections 309 and 310 come into force on a day or days to be fixed by order of the Governor in Council.</Para></Block><Block LineCnt="Y" Align="Yes"><MarginalNote>Order in council<br/></MarginalNote><Para TopMargin="5" LeftMargin="0" FirstLineIndent="2" Bold="Yes">(2) Notwithstanding subsection 114(4) of the <I>Canada Pension Plan</I>, section 315 comes into force on the day on which this Act is assented to, but that section does not apply in respect of the Canada Pension Plan Investment Board unless the lieutenant governor in council of each of at least two thirds of the included provinces, within the meaning of subsection 114(1) of that Act, having in the aggregate not less than two thirds of the population of all of the included provinces, has signified the consent of that province to the amendment made by that section.</Para></Block><Block Align="Yes" LineCnt="N"><Para NoLineBreak="Yes" NoHtml="Yes" Leading="0" Size="0" TopMargin="0" BottomMargin="0"></Para></Block></Bill_Part></Bill>
