if law enforcement agencies of that foreign state, or of Canada, as the case may be, have participated in the investigation of the offence or offences that led to the forfeiture of the property or the imposition of the fine or if the law enforcement agencies' participation led to the forfeiture of the property or the payment of the penalty under the Proceeds of Crime (Money Laundering) Act.

Conditional Amendments

Bill C-6

97. (1) If Bill C-6, introduced in the 2nd Session of the 36th Parliament and entitled Personal Information Protection and Electronic Documents Act (referred to in this section as ``that Act''), is assented to, then

    (a) subsection 7(3) of that Act is amended by adding the following after paragraph (c.1):

    (c.2) made to the government institution mentioned in section 7 of the Proceeds of Crime (Money Laundering) Act as required by that section;

    (b) subparagraph 9(2.1)(a)(i) of that Act is replaced by the following:

      (i) any disclosure of information to a government institution or a part of a government institution under paragraph 7(3)(c), subparagraph 7(3)(c.1)(i) or (ii) or paragraph 7(3)(c.2) or (d), or

    (c) subsection 9(2.3) of that Act is amended by striking out the word ``or'' at the end of paragraph (a) and by adding the following after paragraph (a):

    (a.1) the detection, prevention or deterrence of money laundering; or

    (d) subparagraph 9(2.4)(c)(i) of that Act is replaced by the following:

      (i) any information that the organization has relating to a disclosure to a government institution or a part of a government institution under paragraph 7(3)(c), subparagraph 7(3)(c.1)(i) or (ii) or paragraph 7(3)(c.2) or (d) or to a request made by a government institution under either of those subparagraphs,

(2) Subsection (1) comes into force on the later of the coming into force of section 7 of this Act and section 9 of that Act.

98. The Proceeds of Crime (money laundering) Act, chapter 26 of the Statutes of Canada, 1991, is repealed.

99. The provisions of this Act, other than section 97, come into force on a day or days to be fixed by order of the Governor in Council.
