SUMMARY

This enactment amends the Canada Transportation Act to control noise and vibrations produced by the construction or operation of railways located in close proximity to residential, institutional or commercial establishments at certain times or on certain days.

An Act to amend the Canada Transportation Act (railway noise and vibration control)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1This Act may be cited as the Railway Noise and Vibration Control Act.

2The Canada Transportation Act is amended by adding the following after section 95.‍1:

95.‍11(1)A railway company constructing or operating a railway within 300 metres of any residential, institutional or commercial establishment shall not shunt, couple or decouple cars or leave an engine with its motor idling

  • (a)at any time on a Saturday, Sunday, or legal holiday; and

  • (b)before 8:00 a.‍m. and after 10:00 p.‍m. on any other day.

(2)During a national emergency within the meaning of section 3 of the Emergencies Act, the Minister may authorize the activities referred to in subsection (1) to take place for a period determined by the Minister.

3Paragraph 95.‍2(1)‍(a) of the Act is replaced by the following:

  • (a)the elements that the Agency will use to determine whether a railway company is complying with section 95.‍1 Insertion start and subsection 95.‍11(1) Insertion end ; and

4Subsection 95.‍3(1) of the Act is replaced by the following:

Complaints and investigations

95.‍3(1)On receipt of a complaint made by any person that a railway company is not complying with section 95.‍1 Insertion start or subsection 95.‍11(1) Insertion end , the Agency may order the railway company to undertake any changes in its railway construction or operation that the Agency considers reasonable to ensure compliance with that section Insertion start or subsection Insertion end .
