SOMMAIRE
Le texte modifie la Loi sur les arrangements fiscaux entre le gouvernement fédéral et les provinces afin de prévoir qu’une province qui a un programme dont les objectifs sont comparables à ceux d’un programme fédéral dans un domaine qui relève de la compétence législative de la province peut se retirer de ce dernier.
Il modifie également cette loi et la Loi canadienne sur la santé afin de soustraire le Québec aux conditions et critères nationaux prévus relativement au Transfert canadien en matière de santé.
SUMMARY
This enactment amends the Federal-Provincial Fiscal Arrangements Act to provide that a province with a program whose objectives are comparable to those of a federal program in an area under the legislative authority of the province may withdraw from the federal program.
It also amends that Act and the Canada Health Act in order to exempt Quebec from the national criteria and conditions set out for the Canada Health Transfer.

1 L’article 7 de la Loi canadienne sur la santé devient le paragraphe 7(1) et est modifié par adjonction de ce qui suit :

(2) Le Québec est soustrait à l’application du paragraphe (1) et reçoit la pleine contribution pécuniaire visée à l’article 5.

30.1 (1) La province qui a un programme dont les objectifs sont comparables à ceux d’un programme fédéral peut, à tout moment, choisir de se retirer du programme fédéral, auquel cas elle reçoit une contribution financière correspondant à ce qu’elle aurait reçu pour sa participation n’eût été son retrait.
End of inserted block30.1 (1) A province that has a program whose objectives are comparable to those of a federal program may, at any time, choose to withdraw from the federal program, in which case it shall receive the same financial contribution it would have received had it not withdrawn.

(2) Au paragraphe (1), programme fédéral s’entend de tout régime en vertu duquel le gouvernement fédéral s’engage à verser une contribution financière pour la réalisation d’objectifs nationaux dans un domaine relevant de la compétence législative des provinces.
End of inserted block(2) In subsection (1), federal program means any plan under which the federal government undertakes to pay a financial contribution for the achievement of national objectives in an area under the legislative authority of the provinces.
