SOMMAIRE
Le texte modifie la Loi sur la Société canadienne des postes afin de prévoir que la Société ne peut refuser de fournir un service postal interprovincial comportant le relevage et la transmission de bière, de vin ou de spiritueux et leur distribution directement au consommateur. Il prévoit aussi des exceptions.
SUMMARY
This enactment amends the Canada Post Corporation Act to provide that the Corporation shall not refuse to provide a postal service for the collection, transmission and delivery, direct to consumers, from one province to another, of beer, wine or spirits. It also provides for exceptions.

1 La Loi sur la Société canadienne des postes est modifiée par adjonction, après l’article 5, de ce qui suit :
1 The Canada Post Corporation Act is amended by adding the following after section 5:

5.1 (1) Au présent article :
a) bière s’entend au sens de l’article 4 de la Loi sur l’accise;
b) spiritueux et vin s’entendent au sens de l’article 2 de la Loi de 2001 sur l’accise.

(a) beer has the same meaning as in section 4 of the Excise Act; and
(b) spirits and wine have the same meaning as in section 2 of the Excise Act, 2001.

(4) Le gouverneur en conseil peut, par décret, modifier l’annexe :
a) soit par adjonction du nom d’une province où il est interdit d’importer, d’envoyer, d’apporter ou de transporter, ou de faire importer, envoyer, apporter ou transporter, de la bière, du vin et des spiritueux provenant d’une autre province ou d’exporter, d’envoyer, d’apporter ou de transporter, ou de faire exporter, envoyer, apporter ou transporter, de la bière, du vin et des spiritueux à destination d’une autre province, à condition que le premier ministre de la province ait annoncé l’interdiction à l’assemblée législative provinciale six mois avant la date de sa prise d’effet et ait avisé le ministre de l’annonce;
b) soit par suppression du nom d’une province où l’interdiction ne s’applique plus, à condition que le premier ministre de la province ait fait une annonce à cet égard à l’assemblée législative provinciale et ait avisé le ministre de l’annonce.
End of inserted block(4) The Governor in Council may, by order, amend the schedule
(a) by adding the name of a province in which it is prohibited for a person to import, send, take or transport, or cause to be imported, sent, taken or transported, beer, wine or spirits into the province from another province or to export, send, take or transport, or cause to be exported, sent, taken or transported, beer, wine or spirits out of the province to another province, provided the Premier of the province has announced the prohibition in the provincial legislature six months before the effective date of the prohibition and has notified the Minister of the announcement; or
(b) by deleting the name of a province in which the prohibition has ceased to apply, provided the Premier of the province has made an announcement to that effect in the provincial legislature and has notified the Minister of the announcement.
