SOMMAIRE
Le texte modifie la Loi canadienne sur la protection de l’environnement (1999) afin d’interdire l’exportation dans des pays étrangers de certains types de déchets plastiques destinés à l’élimination définitive.
SUMMARY
This enactment amends the Canadian Environmental Protection Act, 1999 to prohibit the export of certain types of plastic waste to foreign countries for final disposal.

1 L’article 186 de la Loi canadienne sur la protection de l’environnement (1999) est modifié par adjonction, après le paragraphe (1), de ce qui suit :
1 Section 186 of the Canadian Environmental Protection Act, 1999 is amended by adding the following after subsection (1):

(1.1) Pour l’application des paragraphes (1.2) et (1.3), déchet plastique s’entend des types de plastiques énumérés à l’annexe 7.
(1.1) For the purposes of subsections (1.2) and (1.3), plastic waste means any type of plastic listed in Schedule 7.

(1.2) Despite subsection (1), it is prohibited to export plastic waste to foreign countries for final disposal.

(1.3) Sur recommandation du ministre, le gouverneur en conseil peut, par décret, modifier l’annexe 7 pour y ajouter ou en retrancher tout type de plastique.
(1.3) The Governor in Council may, on the recommendation of the Minister, by order, amend Schedule 7 by adding or deleting from it any type of plastic.

(1.4) L’application de l’interdiction prévue au paragraphe (1.2) se fait dans le respect des compétences des gouvernements fédéral et provinciaux.
(1.4) The prohibition provided for in subsection (1.2) shall be applied in a manner that respects the legislative competences of the federal and provincial governments.

272 (1) Every person commits an offence who
(a) contravenes subsection 16(3) or (4), any of subsections 81(1), (3), (4), (10), (11) and (14), 84(2) and 96(3) and (4), section 101, any of subsections 106(1), (3), (4), (10) and (11) and 109(2), section 117 or 123, any of subsections 124(1), (2) and (3), 125(1), (2), (3), (4) and (5), 126(1) and (2) and 139(1), section 142 or 144, subsection 150(3) or (4), section 152, subsection 153(1), section 154, subsection 155(5), section 171 or 181, subsection 185(1), 186(1.2) or (2), 189(1), 202(3) or (4) or 213(3) or (4), paragraph 228(a) or subsection 238(1);

3 The Act is amended by adding, after Schedule 6, the schedule set out in the schedule to this Act.
