SOMMAIRE
Le texte modifie le Code criminel afin d’ériger en infraction la publicité de services de thérapie de conversion offerts moyennant rétribution, ainsi que l’obtention d’un avantage matériel provenant de la prestation d’une thérapie de conversion à une personne âgée de moins de dix-huit ans.
SUMMARY
This enactment amends the Criminal Code to make it an offence to advertise conversion therapy services for consideration and to obtain a financial or other material benefit for the provision of conversion therapy to a person under the age of eighteen.

Attendu :
que le Parlement du Canada reconnaît les dommages causés par les pratiques et traitements visant à modifier l’orientation sexuelle ou l’identité de genre d’un individu;
qu’il importe de protéger la dignité humaine et l’égalité de tous les Canadiens et Canadiennes en décourageant ces pratiques et traitements qui ont des conséquences négatives, en particulier chez les jeunes,
Preamble
Whereas the Parliament of Canada recognizes the damage caused by practices and treatments designed to change an individual’s sexual orientation or gender identity;
And whereas it is important to protect the human dignity and equality of all Canadians by discouraging these practices and treatments in light of their negative consequences, particularly for young people;

172.01 (1) Au présent article, thérapie de conversion s’entend de pratiques, traitements ou services visant à modifier l’orientation sexuelle ou l’identité de genre d’un individu ou visant à éliminer ou réduire l’attirance sexuelle ou le comportement sexuel entre personnes de même sexe. Il est entendu que la présente définition ne vise pas le changement chirurgical de sexe ou tout service qui s’y rapporte.
172.01 (1) In this section, conversion therapy means any practice, treatment or service designed to change an individual’s sexual orientation or gender identity or to eliminate or reduce sexual attraction or sexual behaviour between persons of the same sex. For greater certainty, this definition does not include a surgical sex change or any related service.

(2) Quiconque fait sciemment de la publicité pour offrir une thérapie de conversion moyennant rétribution est coupable :
a) soit d’un acte criminel passible d’un emprisonnement maximal de cinq ans;
b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.
(2) Everyone who knowingly advertises an offer to provide conversion therapy for consideration is guilty of
(a) an indictable offence and liable to imprisonment for a term of not more than five years; or
(b) an offence punishable on summary conviction.

(3) Quiconque bénéficie d’un avantage matériel, notamment pécuniaire, qu’il sait provenir ou avoir été obtenu, directement ou indirectement, de la prestation d’une thérapie de conversion à une personne âgée de moins de dix-huit ans est coupable :
(a) soit d’un acte criminel passible d’un emprisonnement maximal de cinq ans;
(b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.
(3) Everyone who receives a financial or other material benefit, knowing that it is obtained by or derived directly or indirectly from the provision of conversion therapy to a person under the age of eighteen, is guilty of
(a) an indictable offence and liable to imprisonment for a term of not more than five years; or
(b) an offence punishable on summary conviction.
