An Act to amend the Canadian Human Rights Act, the Privacy Act and the Personal Information Protection and Elec­tronic Documents Act
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
Short title
1. This Act may be cited as the Protection Against Genetic Discrimination Act.

CANADIAN HUMAN RIGHTS ACT
2. Section 3 of the Canadian Human Rights Act is amended by adding the following after subsection (2):
Predisposition to disability
(3) If the ground of discrimination is a predisposition to disability that is inferred from the results of genetic testing, the discrimination shall be deemed to be on the ground of disability.

PRIVACY ACT
3. The definition “personal information” in section 3 of the Privacy Act is amended by adding the following after paragraph (d):
(d.1) information resulting from genetic testing of the individual,

4. The heading “Définitions” before section 2 of the French version of the Personal Information Protection and Elec­tronic Documents Act is replaced by the following:

5. Section 2 of the Act is amended by adding the following after subsection (1):
Information derived from genetic testing
(1.1) For greater certainty, personal information includes personal health information, such as information derived from genetic testing.
COMING INTO FORCE
Thirtieth day after royal assent
6. This Act comes into force on the 30th day after the day on which it receives royal assent.
