An Act to amend the Radiation Emitting Devices Act (tanning equipment) and to warn Canadians of the cancer risks of using tanning equipment
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
Short title
1. This Act may be cited as the Tanning Equipment Prohibition and Warning (Cancer Risks) Act.

2. The Radiation Emitting Devices Act is amended by adding the following after section 5:
Tanning equipment
5.1 (1) No person who operates a commercial establishment that provides members of the public with access to tanning equipment may allow a person under the age of 18 years access to such equipment.
No contravention
(2) A person shall not be found to have contravened subsection (1) if it is established that the person attempted to verify that the customer was at least 18 years of age by asking for and being shown documentation prescribed for the purposes of verifying age, and believed on reasonable grounds that the documentation was authentic.
3. The portion of subsection 8(1) of the Act before paragraph (a) is replaced by the following:
Powers of inspectors
8. (1) An inspector may at any reasonable time enter, subject to subsection (2), the premises of any manufacturer, distributor or importer of a radiation emitting device or of a commercial establishment that provides members of the public with access to tanning equipment in which he believes on reasonable grounds there is a radiation emitting device, or any place in which he believes on reasonable grounds there is a radiation emitting device that is owned by a manufacturer, distributor or importer, and may
4. Subsection 13(1) of the Act is amended by adding the following after paragraph (e):
(e.1) regarding warning signs to be posted in commercial establishments where members of the public are provided with access to tanning equipment;

14. (1) Every person who, or whose employee or agent, contravenes section 4, 5, 5.1 or 6 is guilty of an offence and liable

(2) Every person who, or whose employee or agent, contravenes any provision of this Act other than section 4, 5, 5.1 or 6, or any regulation, is guilty of an offence and liable

Amendment of Regulations
6. The Governor in Council may amend the Radiation Emitting Devices Regulations to require
(a) that an English version and a French version of an ultraviolet radiation warning sign measuring 36 cm by 25 cm
(i) be posted in a location that is clearly visible to customers in every commercial establishment where members of the public are provided with access to tanning equipment,
(ii) include in the French version of the sign, enclosed within a black border,
(A) in the upper portion, in red on a white background, the signal word “Danger” with the hazard symbol on both sides,
(B) in the middle portion, the hazard statements “Les appareils de bron-zage peuvent causer le cancer” and “Il est interdit de permettre l'utilisation par les personnes de moins de 18 ans” in yellow on a black background, and
(C) in the lower portion, the following message in black on a white background:
“Le rayonnement ultraviolet émis par les lits de bronzage est cancérogène et augmente considérablement les risques de mélanome et autres cancers. Plus l’exposition régulière débute tôt, plus les risques qui y sont associés sont élevés.
Portez le dispositif de protection des yeux. Suivez les instructions. Les lits de bronzage peuvent causer des brûlures à la peau et aux yeux. L'utilisation de médicaments et de cosmé-tiques peut augmenter les effets des rayons UV. L’exposition aux rayons UV peut avoir des effets nocifs sur la santé et contribuer au vieillissement prématuré de la peau et à la formation d’anomalies cutanées.”,
(iii) include in the English version of the sign, enclosed within a black border,
(A) in the upper portion, in red on a white background, the signal word “Danger” with the hazard symbol on both sides,
(B) in the middle portion, the hazard statements “Tanning equipment can cause cancer” and “It is prohibited to allow use by persons under 18” in yellow on a black background, and
(C) in the lower portion, the following message in black on a white background:
“Ultraviolet radiation from tanning beds is carcinogenic to humans and significantly increases the risk of melanoma cancer and other types of skin cancer. Greater risks are associated with early and repeated exposure.
Use protective eyewear. Follow instructions. Tanning beds can cause skin burns and eye burns. Drugs and cosmetics may increase UV effects. UV exposure can be hazardous to your health and can contribute to premature skin aging and skin defects.”, and
(iv) conform to the diagram set out in Schedule 1; and
(b) that an English version and a French version of an ultraviolet radiation warning label measuring 7.5 cm by 20 cm
(i) be placed on the upper or lower rim or panel of all horizontal full-body and half-body tanning equipment in a clearly visible location that is adjacent to the tanning surface,
(ii) include in the French version of the label, enclosed within a black border,
(A) in the upper portion, in red on a white background, the signal word “Danger” with the hazard symbol on both sides,
(B) in the middle portion, the hazard statements “Les appareils de bron-zage peuvent causer le cancer” and “Il est interdit de permettre l'utilisation par les personnes de moins de 18 ans” in yellow on a black background, and
(C) in the lower portion, the following message in black on a white background:
“L'exposition aux rayons ultraviolets (UV) peut être dangereuse pour la santé pour les raisons suivantes : la surexposition cause des brûlures à la peau et aux yeux. Les effets des rayons UV sont cumulatifs et cancé-rogènes. L'utilisation de médicaments et de cosmétiques peut augmenter les effets des rayons UV. Plus l'exposition régulière débute tôt, plus les risques qui y sont associés sont élevés.
À long terme, l'exposition aux rayons UV peut contribuer au vieillissement prématuré et au cancer de la peau. Suivez les intructions. Portez le dispositif de protection des yeux.”,
(iii) include in the English version of the label, enclosed within a black border,
(A) in the upper portion, in red on a white background, the signal word “Danger” with the hazard symbol on both sides,
(B) in the middle portion, the hazard statements “Tanning equipment can cause cancer” and “It is prohibited to allow use by persons under 18” in yellow on a black background, and
(C) in the lower portion, the following message in black on a white background:
“Ultraviolet (UV) radiation exposure can be hazardous to your health for the following reasons: overexposure causes skin and eye burns. UV effects are cumulative and carcinogenic. Drugs and cosmetics may increase UV effects. Greater risks are associated with early and repeated exposure.
In the long term, UV exposure can contribute to premature aging and skin cancer. Follow instructions. Use protective eyewear.”, and
(iv) conform to the diagram set out in Schedule 2.
