The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:32 a.m. in Room 256-S of the Centre Block, the Chairman, the Honourable Senator John G. Bryden and Rob Anders, Joint Chairmen, presiding.

Representing the Senate: The Honourable Senators Biron, Bryden and Moore (3).

Representing the House of Commons: Rob Anders, Monique Guay, Randy Kamp, Derek Lee, Marc Lemay, Paul Macklin, P.C., Lynn Myers, Tom Wappel and Merv Tweed (9).

Also present: Jean-François Lafleur, Joint Clerk of the Committee (House of Commons); from the Parliamentary Research Branch of the Library of Parliament: François-R. Bernier, Senior Counsel and Rob Billingsley, Counsel.

In attendance: The official reporters of the Senate.

The committee continued to examine its permanent order of reference as set out in section 19 of the Statutory Instruments Act, R.S.C. (1985), Chapter S-22, which provides the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

On SOR/88-58 — Air Transportation Regulations, it was agreed that committee counsel would contact the statutory instruments officer at Transport Canada and that the Joint Chairmen write to the Minister of Transport to share some of the committee's observations.

On SOR/92-26 — Frontier Lands Petroleum Royalty Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Natural Resources Canada to share some of the committee's observations.

On SOR/94-651 — Energy Efficiency Regulations, as amended by SOR/2003-136, it was agreed that committee counsel would write to the statutory instruments officer at Natural Resources Canada to share some of the committee's observations.

On SOR/2002-60 — Regulations Amending the Canadian Aviation Regulations (Part IV), it was agreed that committee counsel would write to the Statutory Instruments officers at Transport Canada to share some of the committee's observations.

On SOR/85-686 — Pest Control Products Regulations, amendment, it was agreed that the Joint Chairmen would write to the Minister of Health to share some of the committee's observations.

The committee discussed its Second Report.

On SOR/97-313 — Regulations Amending the Food and Drug Regulations (923), it was agreed that committee counsel would review the file at a later date and apprise the committee of action taken.

On SOR/2000-416 — Regulations Amending the Health of Animals Regulations; SOR/2003-409 — Regulations Amending the Health of Animals Regulations, it was agreed that committee counsel would write to the statutory instruments officer at the Canadian Food Inspection Agency to share some of the committee's observations.

On SOR/2002-435 — Regulations Amending the Fish Inspection Regulations, it was agreed that committee counsel would examine the file at a later date and apprise the committee of action taken.

The committee examined SI/2003-156 — Order Declaring that all Provisions of Part X of the Financial Administration Act Apply to Parc Downsview Park Inc.

On SOR/92-446 — Transportation Safety Board Regulations, it was agreed that committee counsel would examine the file later and apprise the committee of action taken.

The committee examined SOR/95-190 — Nova Scotia Offshore Area Petroleum Production and Conservation Regulations; SOR/95-144- Nova Scotia Offshore Area Petroleum Geophysical Operations Regulations; SOR/2005-2 — British Columbia Sex Offender Information Registration Regulations; SOR/2005-139 — Regulations Amending the Great Lakes Sewage Pollution Prevention Regulations (Miscellaneous Program); SOR/2005-172 — Regulations Amending the Veterans Review and Appeal Board Regulations (Miscellaneous Program); SOR/2005-189 — Regulations Amending the Boating Restriction Regulations.
