An Act to amend the Divorce Act (limits on rights of child access by sex offenders)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Short title

1. This Act may be cited as Lisa's Law.

R.S., 1985 c. 3 (2nd Supp.)

2. Section 16 of the Divorce Act is amended by adding the following after subsection (9):

Persons imprisoned for sexual offences

(9.1) An order made under this section is deemed to contain a provision that, unless the spouse or former spouse who has custody consents otherwise, any right of access to the child granted to the other spouse or former spouse is suspended during any time the other spouse or former spouse is serving a term of imprisonment for an offence

    (a) under any provision of the Criminal Code of which the child was the victim, or

    (b) under any of the following provisions of the Criminal Code, whether or not the child was the victim:

      (i) section 151 (sexual interference),

      (ii) section 152 (sexual touching),

      (iii) section 153 (sexual exploitation),

      (iv) section 155 (incest),

      (v) section 163.1 (child pornography),

      (vi) section 170 (parent procuring sexual activity),

      (vii) section 172 (corrupting children),

      (viii) section 271 (sexual assault),

      (ix) section 272 (sexual assault with a weapon),

      (x) section 273 (aggravated sexual assault).
