Transitional Provisions

Regulations remain in force

197. (1) Regulations relating to food made under the Food and Drugs Act or the Consumer Packaging and Labelling Act and regulations made under any of the Canada Agricultural Products Act, the Feeds Act, the Fertilizers Act, the Fish Inspection Act, the Meat Inspection Act and the Seeds Act remain in force and, subject to subsection (2), are deemed to have been made under this Act, in so far as they are not inconsistent with this Act, until they are repealed or others made in their place.

Regulations remain in force

(2) Regulations and portions of regulations referred to in subsection (1) that relate to the enforcement of any Act referred to in subsection 11(1) of the Canadian Food Inspection Agency Act or to any matter referred to in section 66 of that Act are deemed to have been made under that Act.

Existing licences and registrations

198. Licences and registrations under the Canada Agricultural Products Act, the Feeds Act, the Fertilizers Act, the Fish Inspection Act, the Meat Inspection Act and the Seeds Act remain in force according to their terms and conditions for the remainder of the period during which they would have been in force had those Acts not been repealed.

Issuance of new licences and registrations

199. (1) Until a day or days to be fixed by order of the Governor in Council in respect of any or all of paragraphs (a) to (g),

    (a) persons may be licensed under regulations made under the Canada Agricultural Products Act, the Fish Inspection Act and the Meat Inspection Act that remain in force under section 197;

    (b) establishments, as defined in subsection 2(1), may be registered under regulations made under the Canada Agricultural Products Act, the Meat Inspection Act and the Fish Inspection Act that remain in force under section 197;

    (c) activities and operations regulated by this Act may be licensed, registered or accredited under regulations made under the Canada Agricultural Products Act that remain in force under section 197;

    (d) labels, as defined in subsection 2(1), may be registered under regulations made under the Canada Agricultural Products Act and the Meat Inspection Act that remain in force under section 197;

    (e) feeds, as defined in subsection 2(1), may be registered under regulations made under the Feeds Act that remain in force under section 197;

    (f) fertilizers and supplements, as defined in subsection 2(1), may be registered under regulations made under the Fertilizers Act that remain in force under section 197; and

    (g) varieties of seeds, as defined in subsection 2(1), may be registered under regulations made under the Seeds Act that remain in force under section 197.

Pending applications

(2) Applications for licences or registration under the Canada Agricultural Products Act, the Feeds Act, the Fertilizers Act, the Fish Inspection Act, the Meat Inspection Act or the Seeds Act that were made before the repeal of those Acts may be dealt with in accordance with subsection (1).

Deeming - licences

200. Licences that remain in force under section 198 or that are issued under section 199 are deemed to be licences issued under this Act.

Deeming - registrations

201. Registrations, other than registrations of labels, feeds, fertilizers, supplements and varieties of seeds, as those terms are defined in subsection 2(1), that remain in force under section 198 or that are made under section 199 are deemed to be licences issued under this Act.

Regulations

202. The Governor in Council may make regulations that the Governor in Council considers necessary to give effect to sections 197 to 201, including regulations

    (a) deeming the deemed licences referred to in section 200 to be of a prescribed class of licence issued under this Act; and

    (b) providing for any other transitional matter.

Coming into Force

Coming into force

203. This Act or any of its provisions, or any provision of an Act enacted or amended by this Act, comes into force on a day or days to be fixed by order of the Governor in Council.

Authority to substitute actual date

204. On or after the day on which section 5.1 of the Plant Breeders' Rights Act, as enacted by section 136, comes into force, the Governor in Council may, by order, amend that Act by replacing references to the day on which section 5.1 of that Act comes into force with references to the actual date on which that section came into force.
